자치경찰제 실시에 따른 바람직한 사무배분의 방향 연구

우리나라는 경찰 창설 이래 국가경찰제도를 유지해왔으나, 정치적 중립성, 분권화와 민주화의 대세에 맞추어 자치경찰제도 도입을 추진하고 있다. 이 연구에서는 바람직한 한국 자치경찰제의 모형을 논하는데 있어 사무배분의 범위에서 제시하고자 하였다. 현재 제주자치도에서 자치경찰제도를 시행하고 있지만, 권한의 제한적 범위와 법령상의 문제 등으로 시행착오를 겪고 있는 상황이다. 이 논문에서는 자치경찰에 대한 수사 권한 부여와 국가경찰사무와 자치경찰사무의 명확한 배분, 그리고 자치경찰과 국가경찰간의 상호협력방안을 제시하였다. 자치경찰의 수사권 부여 방향과 관련하여 현재 기초자치단체에서 보유하고 있는 특별사법경찰사무 외에 자치경찰에 지역수사에 관한 독자적 수사권을 부여하여 지역치안 역량을 강화해야 자치경찰의 역할을 수행할 수 있을 것이다. 또한 국가경찰사무와 자치경찰사무는 명확히 구분하여 국가경찰사무의 범위를 구체적으로 열거하여 한정하고 자치경찰이 수행할 수 없는 사무를 국가경찰이 수행하는 방식으로 진행하여야 할 것이다. 마지막으로 국가경찰과 자치경찰의 상호협력하기 위해 이와 관련하여 법률을 제정할 필요성을 제기하였다.
Abstract
South Korea has maintained the National Police System since the establishment of the Korean Police. However, since the beginning of the local self-governing system, there have been trying to introduce and design the new police system for political neutralization, decentralization and democratization. The purpose of this study is to analyse local police system which will be operated in South Korea and to provide the desirable range of distribution of police affairs. Now in the South Korea only the Jeju province's area is put in force, operation the Local Police System, but has a lot of problem for the restrictive range of authority and a defect in law. For the preferable Local Police System, this paper has suggested about the power of crime investigation of Local Police, the precise distribution of police affairs and the mutual cooperation between Local Police and National Police. First, about the power of crime investigation of Local Police, there should be conferred the crime investigation power in some restricted boundary crime, which are happened mostly against the special crime law. Second, in the case of the distribution of police affaires, the range of National Police affairs should be clearly specified and National Police should perform affairs that could not achieve by Local Police. Finally, for the mutual cooperation between Local Police and National Police, there should be establish the cooperaton legislation.
