본 연구는 광역정부와 기초정부간의 규제관계를 분석하기 위해 경기도내 31개 시ㆍ군을 대상으로 등록규제의 실태를 분석하고, 이에 대한 개선방안을 제시하고자 한다. 이를 위해 경기도와 경기도내 31개 시ㆍ군에서 시행되고 있는규제 현황 및 실태에 대해 정확히 진단한 후, 다음으로 자치사무와 위임사무에 따른 세부 분석하였다. 분석결과 경기도의 규제 수는 총 5,756건(도: 156건, 31개 시·군: 5,600건)으로 규제사무의 수가 많은 수준으로 나타났다. 부문별로분류하면 경기도와 시·군 모두 국토도시개발 관련 규제가 상대적으로 많은 것으로 나타났으며, 유형별로 분류하면 경기도와 시·군 모두 기준설정에 대한 규제가 상대적으로 많은 비중을 차지하는 것으로 분석되었다. 그리고 중앙부처를기준으로 분석한 결과 경기도와 시·군 모두 국토교통부와 연계된 규제가 가장 많은 것으로 분석되었다. 이러한 결과는각 시·군이 마련한 대안을 검토하고, 중앙과 지방간 정부관계에서 지방의 특수성이 반영된 규제가 우선적으로 충실히실행될 수 있는 대안을 마련할 필요가 있음을 보여주고 있다.
Abstract
This study analyzed the registration regulation status of 31 city and counties in Gyeonggi-do soas to analyze the regulation relationship between the metropolitan government and the primarygovernment and to present ways for improvements thereby. To that end, an accurate diagnosis wasconducted on the status of the regulations which are implemented in 31 31 city and counties inGyeonggi-do and Gyeonggi-do itself. After that, a detailed analysis of the autonomous affairs andconsigned affairs. As a result of the analysis, the number of regulations affairs in Gyeonggi-do was5,756 (156 cases in Gyeonggi-do and 5,600 cases in city and counties), showing the number ofregulations. When classified by sectors, Gyeonggi-do and affairs showed a relatively high numberof regulations in the land developments. When classified by types, Gyeonggi-do and city and countiesall showed a relatively high number of regulations on the establishment of standards. And as aresult of the analysis of the Central government's departments, Gyeonggi-do and city and countiesshowed the highest number of regulations on the Ministry do Land Infrastructure and Transport. These results show that city and counties should have alternatives where regulations which reflectregional features in the relationship between the central government and regional government sothat regional special features can be reflected well.
