동남아시아 민관협력사업(PPP)에 관한법제도 현황 및 진출전략- 베트남, 인도네시아를 중심으로 -

최근 베트남 및 인도네시아는 PPP관련 법제도가 개선을 통한 민간자본 유치로 해당국들의 인프라 구축사업을 본격적으로 모색해 나가고 있지만 국내 건설기업의 PPP사업 진출은 미비한 실정이다. 본 연구의 목적은 베트남 및 인도네시아에 대한 PPP관련 법령의 현황 및 문제점을 제시하고, 국내 기업의 바람직한 진출 전략을 모색하기 위한 것이다. 이에 두 나라의 PPP관련 법제도를 중심으로 문헌분석 및 전문가 인터뷰를 시도하였으며, 분석결과는 다음과 같다. 첫째, 우리나라 정부는 베트남 및 인도네시아 정부의 공적역량강화를 위한 경험을 지속적으로 전수하고, 정부 간협의체계를 강화하여 사업리스크를 해소해야 한다. 둘째, 국내 기업은 장기적인 관점에서 현지 사업추진 경험을 축적하고, 재원조달 방안을 확보하는 것이 중요하다. 셋째, 경쟁력 있는 현지 업체와 기술 및 정보공유를 위한 협력관계를구축해야 한다. 마지막으로 수주능력이 낮은 중소기업에 대해 PPP사업 진출을 위한 지원책을 마련해야한다. 본 연구의 결과는 베트남 및 인도네시아의 PPP사업 진출 시 현지 법제도적 여건을 고려한 맞춤형 전략을 수립하는데 기초자료로 활용할 수 있다.
Abstract
Recently, Vietnam and Indonesian governments have been trying to promote infrastructure development through private investment by improving their legal environment of public-privatepartnership (PPP). However, Korean construction companies have seldom participated in the PPP projects in these countries. The study aims at exploring suitable strategies for Korean construction companies to participate in this area through analyzing the legal environment of PPP in Vietnam and Indonesia. The study reviewed various documents and conducted interviews of experts focusing on the legal system on PPP of Vietnam and Indonesia. The followings are the brief results of the study. First, the Korean government needs to improve the capacity of government officials on PPP in these countries by sharing its PPP experiences, and strengthening cooperative relationships in order to reduce the risk associated with PPP projects of Korean private parties. Second, Korean private parties need to accumulate more experiences in conducting business in these countries as well as seeking effective funding sources for PPP projects. Third, Korean private parties need to establish cooperative relationships with competitive local firms to share information and technologies. Finally, there should be appropriate government support for mid-sized-enterprises that do not have sufficient capacity, to find a way to participate in oversea PPP projects. The study is expected to be used for developing country-specific-strategies considering the analysis of the legal environment of PPP in Vietnam and Indonesia for Korean private parties to participate in the PPP in these countries.
