본 연구의 목적은 광역자치단체의 경계선지능인 평생교육 지원 조례에 관한 비교 연구를 통해 조례의 개정 방안을 도출하는 것이다. 국가법령정보센터 내의 자치법규시스템에서 제공하는 10개 광역자치단체의 ‘경계선지능인 평생교육 지원 조례’를 내용분석 방법으로 비교하였다. 분석 결과, 이상적인 사회복지조례의 내용적 체계에 경기도 조례가 가장 부합하였다. 조례 개정 방안으로, 주민의 권리 조항 신설, 공급자 관점이 아닌 수요자 맞춤형 법조문 제정, 「평생교육법」에근거한 연도별 시행계획 수립 및 실태조사 실시를 강행규정으로 변경, 지원대상에서 인지능력 부족을 인지능력 또는 학습능력 부족으로 변경, 조기진단을 포함한 주기적 진단 시스템, 생애주기별 맞춤형 평생교육프로그램의 선택권 보장, 가족 및 종사자 상담 및 인권교육, 당사자를 위한 심리·정서 상담, 자조모임지원 등의 지원사업 확대, 당사자·가족·종사자가포함된 위원회 신설, 전문인력 양성 신설을 제안하였다.
Abstract
The purpose of this study is to derive plans for revising the ordinance through a comparative study on lifelong education support ordinances for borderline intellectual functioning. The ordinances of 10 metropolitan governments provided by the National Law Information Center’s autonomous law system were compared and analyzed using content analysis. As a result of the analysis, the Gyeonggi-do ordinance was the most closely matched for the content system of ideal social welfare ordinance. As a discussion on revision of ordinances, new provisions on civil rights, enactment of legal provisions tailored to consumers rather than suppliers, compulsory provisions for annual implementation plans and surveys based on the Lifelong Education Act and change from lack of cognitive ability lack of cognitive ability or learning ability, periodic diagnosis system including early diagnosis, guarantee of choice of lifelong education program customized for each life cycle, counseling and human rights education for family and workers, psychological and emotional counseling, and self-help group support, new provisions on committee including the BIF, families, and employees, and new provisions on professional personnel training were suggested.
