각국 여경제도 및 운영에 대한 비교 연구- 영국·미국·일본·프랑스·한국 중심으로 -

2006년 인권위원회에서는 경찰대와 경찰간부후보생 여성10% 채용과 순경 채용시 여성 20% 제한이 평등권침해라며 경찰청에 폐지를 권고하였다. 그러나 물리력사용이라는 업무특수성과 출산, 육아의 이유를 들어 거부하였다. 이는 3만 건을 넘는 여성관련 범죄와 49.2%의 여성이 경제활동에 참여하고 있는 현실과는 상반된 면이 있고 경찰내의 다양성확보와 여성의 인권보호라는 측면에서 제고되어야 할 것이다. 미국, 영국, 호주, 프랑스 등 외국의 경우 채용시 성별분리채용이 성차별이라는 이유로 폐지하였으며 경찰내의 여경에 대한 복지, 지위, 시설확보, 성차별에 관한 집단적, 개인적 소송이 진행되고 있다. 경찰업무의 80%정도는 법집행이나 범죄와 무관한 서비스 업무이고 권위적이고 강압적인 경찰태도도 시민 지향적으로 변화되어 가고 있다. 여성이 경찰업무를 수행하는 데 일부 부서를 제외하고는 적합하지 못하다는 주장은 설득력을 잃고 있다. 선진국의 여경은 1910년대부터 100년이라는 기간동안 여경 지위와 역할에 대한 인식과 노력을 기울여왔고 이제는 UN이나 IAWP등 국제적 단체를 형성해 인류애적인 활동까지 벌여나가고 있다. 그러나 한국의 여경은 65년의 역사에도 불구하고 여경의 수는 전체경찰의 6%에 머무르고 있고 여경의 96%정도가 경위이하의 비간부이며 90%가 단순내근업무를 담당하고 있다. 더욱 심각한 문제는 조직내외부적으로 여경 문제에 대한 인식이나 공감대가 형성되지 못하고 있다는 점이다. 본 연구는 단순히 여경의 지위향상과 승진인원확대라는 측면이 아니라 여성의 인권보호와 경찰내부의 다양성확보차원에서 각국의 여경역사, 제도, 활동을 분석하고 한국여경에의 시사점을 제시하고자 하였다.
Abstract
The National Human Rights Commission requests the abolition of women quota (10% KNPU students, 10% KNPA students and 20% police officers) in police officer recruitment. However NPA denied it because police work needs the physical strength and childbirth etc. This denial cannot meet the current situation that women crimes are over 30,000 and women economic population are 49.2%. But the abolition is necessary for the diversity and women right protection. USA, UK, France and Australia demolished the women quota in police officer recruitment. These countries' women polices even suit against the sex discrimination. 80% police works are not law enforcement but service, so women are not fit for the police work is just prejudice. From 1910, These countries' women police have made an effort to enhance the women polices' right and their status. Even 65 years history, Korea women police ranks are very low and their works are simple desks jobs. More serious thing is that they do not think their status is low and they have serious problems. This study is not only for the women police right and status but also for the women right and the diversity in the police system. Through the other countries police structure, culture and association analysis, it will suggest the vision of Korea women police.
