Court Interpretation System in the U.S.: Case of the State of Maryland and Implications for Korea

이 연구의 목적은 미국의 법정통역제도에 관한 검토를 통해 우리나라의 법정통역제도 도입을 위한 함의를 도출하는 것이다. 이 논문에서는 체계적인 법률과 윤리규정을 갖추고 있는 미국 메릴랜드 주의 사례를 분석한다. 미국 연방정부의 법에 근거하여 법정통역 제도를 구비한 메릴랜드 주는 법정통역인을 주 공무원으로 고용하고있지는 않지만 엄격한 시험을 통해 인증된 법정통역인(Certified CourtInterpreter)과 예비법정통역인(Eligible Court Interpreter)으로 구분하고 전문인으로서의 대우와 적절한 임금체계를 갖추고 있다. 본 논문은 결론적으로 다음과 같은 사항들을 제시힌다. 첫째, 사법통역(Judiciary Interpretation)은 용어로서 적절하지 않고 전 세계적으로 보편적으로 사용되는 법정통역(CourtInterpreter)이라는 용어가 적절하다. 사법통역(Judiciary Interpretation)은법조문의 의미와 적용범위 및 판례의 해석 등과 같은 넓은 의미를 포함하고 있기때문에 법정에서의 통역이라는 본래의 기능을 넘어서는 광범위한 의미를 가지고 있어서 오해의 소지가 있기 때문이다. 둘째, 질적으로 우수한 법정통역제도를 겆추기위해서는 현재의 대법원예규보다는 법체계상 수준이 높은 법을 제정할 필요가 있다. 법 제정을 통해 법정통역인 인증제도와 대우, 교육의 필요성에 대한 내용을 포함하여 법정통역제도에 대한 제도적 기반을 갖추도록 해야 한다. 셋째, 법정통역인에 대한 인증제도는 그 수준을 구분하여 2단계 또는 3단계로 구분할 필요가 있다. 넷째, 법정통역인에 대한 임금이 현실화 되어야 한다. 대우의 개선은 우수한 법정통역인을 양성하는 필요조건이기 때문이다. 다섯째, 법제도적 기반 정비와 함께 윤리규정 또는 강령의 수립도 이루어져야 한다. 여섯째, 법정통역제도의 기반조성을위해 법원은 법조인, 통번역전문가, 정책전문가들을 포함한 위원회를 구성하고 이위원회에서 법정통역제도에 관한 종합계획을 마련할 필요가 있다.
