국내 刑事裁判의 法庭通譯에 관한 小考

국내의 외국인 범죄자 수가 해마다 증가 추세를 보이고, 그 국적도 다양해지고 있다. 이에 양질의 통번역 서비스가 사법영역에서 필요해지고 있다. 그러나 여전히 인력 모집, 관리, 운영 등에 공백이 있어 원활한 재판 운영과 피고인의 기본권 보장이 우려된다. 이에 본 연구는 법정통역 관련 규정인 「통역·번역 및 외국인 사건 처리 예규(재일 2004-5)」를 기준으로 현행 제도와 운영 현황의 문제점을 고찰하고, 한국외대 연구팀이 대법원 행정처의 의뢰를 받아 작성 발표한『법정 통·번역인 평가에 관한 연구』를 기반으로 개선 방안을 제안하고자 한다. 법정통역의 운영, 통번역인의 선발, 최초 교육 및 재교육, 보수 개정, 법정 통번역인의 신분 정립, 통번역 서비스 운영 및 사용 절차 등 항목을 중심으로 기술하여 향후 국내 법정 통번역 서비스 수준 제고에 보탬이 되고자 한다.
Abstract
The number of foreigners who violate the law in Korea is increasing by the year, and their nationalities continue to diversify. The situation necessitates high-quality translation and interpretation services in the courtroom. However, gaps remain in the recruitment, management and deployment of competent personnel, raising concerns over the ability to conduct trials smoothly and guarantee defendants’ basic rights. The present study uses Rules for Court Interpretation and Translation for Cases Involving Non-Korean Speakers (Jea-il 2004-5) as the basis for examining problems in Korea’s current regulations concerning court interpreting, and suggests improvement measures based on the Study on the Evaluation of Legal Translators, written by the Hankuk University of Foreign Studies research team at the request of the Supreme Court Administration. This study aims to help enhance the quality of court interpretation services provided during criminal trials in Korea going forward by studying the current operation of court interpretation for criminal trials, the selection of translators and interpreters, their initial training and retraining, adjustments in their remuneration, the establishment of a proper social standing for court interpreters, and procedures for operating and using interpretation and translation services.
