1894년 淸日戰爭이 발발하고 1895년 下關條約이 체결되면서 조선은 自主・獨立國 지위를 획득하였다. 이러한 과정을 두고 기존 연구들은 淸・日이 체결한 下關條約에서 규정한 “자주・독립”을 강조함으로써 조선 독립의 타율적 성격을 강조하는 데 주력하였다. 그러나 한국에서 그 下關條約에서 언급된 “독립”의 실체에 대한 구체적인 규명은 아직 미진한 상태이다. 물론 下關條約으로 인하여 조선은 淸의 宗主權으로부터 벗어나 獨立自主를 얻을 수 있게 되었다. 다만 그것은 조선이 스스로 쟁취한 것이 아니었고 일본에 의하여 주어진 것이었다. 조선의 국제법적 지위를 규정하는 下關條約에 조선은 참여하지도 못했다. 청일전쟁 시기 조선 “독립”의 초점을 1895년 청・일 사이에 체결된 下關條約에만 두고 있는 한 이 과정은 일본에 의한 타율론적 혐의를 벗어나기 어렵다. 그럼에도 불구하고 필자의 검토 결과 조선은 開戰 이전부터 請兵이 조선의 자주적 결단에 따른 것임을 일본 측에 강조한 바 있다. 특히 조선이 屬邦 章程을 폐기하고 屬國 지위를 청산함으로써 자주・독립을 달성한 점을 주목할 필요가 있다.
Abstract
In 1894, the Sino-Japanese War broke out and in 1895, the Treaty of Shimonoseki was concluded and Chosŏn became a Sovereign and Independent state(自主獨立國). Based on this process, previous studies have focused on emphasizing the heteronomous nature of Chosŏn independence by emphasizing the "Sovereign and Independence" stipulated by the Treaty of Shimonoseki concluded between Qing(淸) and Japan. However, it is true that the specific investigation of the entity of the "independence" mentioned in the Treaty of Shimonoseki is still insufficient in Korea. The Treaty of Shimonoseki, of course, allowed Chosŏn to gain independence from Qing's suzerain authority. In fact, just the independence was not accomplished by Chosŏn unaided but was given by Japan. Chosŏn did not even participate in the Treaty of Shimonoseki, which prescribes the international legal status of Chosŏn. As long as Chosŏn's "independence" focuses only on the Treaty of Shimonoseki between Qing and Japan in 1895 during the Sino-Japanese War, this process is hard to escape from the heteronomous charges for a process being done by Japan. Nevertheless, my (the author's) review suggests that Chosŏn had been issuing voluntary troop dispatch requests prior to the opening of the Sino-Japanese War. In particular, it is noteworthy that Chosŏn voluntarily achieved self-reliance and independence by abolishing the subject state regulations of trade and liquidating the status of Dependent state(屬國).
