본고에서는 소비자분쟁 해결을 위해 가장 중요한 ODR 방법들에 관하여 검토해 보았는 바, 이와 관련하여 자동화 협상, 협상지원, 온라인 조정, 온라인 중재, 온라인 소액청구법정 절차 등을 살펴보았다. 실질적으로 분쟁내용, 재판관할권, 참여자들에 따라 서로 다른 ODR 방법이 적합할 것이다. ICT는 ODR에 있어서 핵심적인 역할을 담당하고 있기 때문에 본고에서는 제4자로서의 기술의 역할에 대해서도 함께 평가하였다. 또한 ODR 방법 및 보안문제는 참여자들의 요구를 고려해야 할 필요가 있음을 언급하였다. 그리고 특히 중립적인 제3자는 활용되고 있는 ICT 도구들의 장단점들을 명확하게 이해하고 있어야만 한다. ODR 개발에 대한 미래의 기대는 매우 낙관적인 것으로 전망된다. 이에는 크게 두 가지의 이유가 있는데, 그 하나는 B2C 온라인거래는 ODR 기술과 함께 발전하고 있기 때문이다. 즉 ODR은 여전히 초기단계라 할 수 있으며, 이는 온라인거래를 통해 탄생된 것이기 때문이다. 다른 하나는 ODR의 성장속도는 가상공간의 확장, 전자상거래의 발전, 기술의 진보, 사용자 친화적인 ODR 플랫폼의 개발 등에 크게 의존하게 될 것이며, 이러한 현상들은 오늘날 더욱 더 활기를 띄고 있기 때문이다.
Abstract
This paper mentioned the most significant ODR methods for resolving consumer disputes, which are automated negotiation, assisted negotiation, mediation, arbitration and small claims court procedures. Depending on the dispute, the jurisdiction, and participants involved, it will be more appropriate one or another ODR method. Since ICT plays a central part in ODR, the role of technology as the fourth party was evaluated. ODR methods and security issues need to take into account the needs of disputants. Parties, in particular third neutrals, should clearly understand the weakness and strengths of the ICT tools used. The future expectation for ODR development seems optimistic. There are two reasons for this : B2C online trade is growing as well as ODR technology. ODR is still in an early stage of development and as it was born online : the speed of its growth will depend upon the expansion of cyberspace, the progression of e-commerce, the evolution of technology and the development of user-friendly ODR platforms.
