1910년대 신소설은 작가가 분명한 시대로 비약하고 창조적 사유들이 더욱 발흥되어야 할 시기에서 저작권의 혼란과 매매 관행이 일어났으며 이는 신소설의 발전을 어둡게 한 하나의 요인으로 작용하였다. 이 글의 목적은 이러한 혼란과 관행의 근본적인 원인을 찾는 데 있었고, 당시 한국에 적용된 <일본저작권법>과 출판탄압의 수단이었던 <출판법>에서 이에 대한 타당한 원인을 찾아내었다. 이제까지 연구되어 왔던 작품의 미학적 탐구 방법이나 서지학 중심의 미시적 관점으로 신소설의 행로와 성격을 온전하게 이해할 수 없다. 문제의 본질은 신소설의 저작권 매매 관행이 일어난 원인과 이유가 무엇인가 하는 점이다. 무엇이 신소설을 비롯한 1910년대 소설의 저작권을 혼란하게 하였고 왜 저작권의 매매가 성행하게 되었고 이러한 문제들이 1910년대 신소설에 미친 영향이 무엇인가 하는 점이다. 이 글에서 세 가지 원인을 처음으로 제시하였는데 이 배경에는 1910년대라는 특수한 시대 상황이 놓여있다. 첫째, 일제 출판법에 의해서 저작겸 발행자 제도가 허용되었다는 점이다. 둘째, 일제 출판법의 혹심한 제재와 이중 검열제도이다. 셋째는 한글 저작권의 등록 불허와 방기 정책이다. 이 세 가지의 압제정책이 출판과 유통환경을 열악하게 만드는 주요 원인으로 작용하였으며, 이러한 환경 아래서 저작권의 매매 관행과 혼란이 야기되었고 나아가 1910년대 신소설의 행로와 성격을 규정한 하나의 요인이 되었다
Abstract
Confusion in the copy rights of new novels in the 1910s and the practice of trading the copy rights were obstacles to the development of new novels. The present study found the reasonable causes of confusion in the copy rights of new novels in the 1910s and the practice of trading the copy rights in the old Japanese Copy Right Act applied to Korea in those days and the Publishing Act, which was a means of oppressing the press in Korea. Aesthetic studies on novels or environmental microscopic views used in research so far cannot give the full understanding of the path and nature of new novels. The essential question is what the fundamental cause of the practice of trading the copy rights of new novels is. Namely, the questions are what caused confusion in the copy rights of novels in the 1910s including new novels, why copy rights were traded so frequently in those days, and whether these problems hindered the development of novel literature in the 1910s. In this study, we suggested three causes, and they are in the peculiar historical background of the 1910s. First, the author and publisher system was permitted by the Japanese Publishing Act. Second, strict restriction and double inspection were applied by the Publishing Act. Third, copy rights in Korean were not allowed to be registered, and they were abandoned. These oppressive policies were the major causes that aggravated the environment of publishing and distribution. They resulted in confusion in copy rights and the practice of trading copy rights, and furthermore, defined the path and nature of new novels in the 1910s.
