일제강점기 저작권 분쟁 사례에 관한 연구 -신문과 잡지의 문학/문화 관련 기사를 중심으로

Abstract

The purpose of this study is to examine the cases of copyright disputes in newspapers and magazines during the Japanese colonial period, and to examine the meaning of literature and cultural history. The introduction of modern copyright law in Korea was in August 1908, when the Japanese government requested the US-Japan Treaty on Inventions, Designs, Trademarks, and Copyrights in Joseon. Then, when Korea was merged with Japan on August 29, 1910, the copyright decree enacted in Japan was promulgated in Korea, and the law was applied and enforced in various cultural industries, including books. Since the introduction of the copyright bill in Joseon during the Japanese colonial period, the perception of copyright spread throughout society, and in 1910, the first copyright infringement lawsuit took place. This incident led to several copyright litigations and copyright disputes in the literature and related fields. The tasks covered in this article have been mentioned by researchers in the fields of law (copyright), journalism, publishing, and history, but they have been briefly mentioned and the specifics have not been summarized. This study summarizes the cases of copyright litigation that occurred after the Copyright Act in 1910, and looks at the main contents. Copyright is closely related to the distribution of books and literature, and it is expected to expand the scope of literature and related fields and contribute to related fields.
