미국 장애인권리옹호체계(P&A System)의 국내법체계 수용가능성

장애인차별금지법 제정으로 말미암아 장애인인권에 가시적인 성과가 있었음에도 불구하고, 실효적인 장애인인권보장이 구현되지 못하는 가운데, 국내에서는 일찍이 미국에서 발달장애인의 인권보장을 위해 시작된 장애인권리옹호체계(P&A System)에 대한 관심이 커지고 있다. 본 논문에서는 미국 P&A체계의 역사와 기구의 성격 및 권한 그리고 자금지원 등과 관련한 다양한 논점들을 미국의 발달장애인지원 및 권리장전법을 중심으로 살펴보면서, 미국에서의 성과와 그에 대한 평가를 겸하여 보고, 구체적인 사례도 살펴보고자 한다. 나아가 위 P&A체계의 국내 도입과정에서 가장 문제가 되는 구체적인 입법정책의 세가지의 접근법을 소개하고, 이미 제정 시행되고 있는 장애인차별금지법에 장애인인권보장을 위한 P&A체계를 도입하는 것이 가장 바람직하고 현실적이지 않을까 하는 의견을 개진하였다. 본 논문이 장애인권리옹호체계의 국내도입과 관련된 심층적인 토론과 그 후 있게 될 입법과정에서 방향을 제시할 수 있기를 기대한다.
Abstract
In spite of the effectuation of Koreans With Disabilities Act (“KDA”) in 2008, there are still some doubts to ensure disabled persons' human rights effectively. For this reason, interest and concern on P&A system rises for enhancing the rights of the people with disabilities. In this article, we review the history and experience around P&A system in America, especially on the issues of agency and fund allocation related to the DD Act. Also we evaluate the system from the objective view and explore the relative cases and reports. Among three possible ways to accept the system in Korea, I propose that the P&A system could be articulated into KDA and if so, it will work more effectively and desirably. This article would give some guidance on the issue that introduction and adaptation of P&A system into Korean legal system.
