Abstract

When Americans with Disabilities Act was enacted in the United States, commentators worried that Title III of the Act did not provide enough incentive because it did not allow plaintiffs to pursue damages. However, for better or worse, some plaintiffs’ lawyers started filing cases to enforce the Americans with Disabilities Act. The number of reported cases being filed in the federal courts is around 10,000 in 2019. In contrast, even though Korea enacted the Act on the Prohibition of Discrimination Against Persons with Disabilities, very few cases are being filed in Korean courts. Korean lawyers are less willing to bring the cases to the courts compared to the United States lawyers. I argue that this is because the Korean law did not take into the account the incentive of the plaintiff and her lawyer. To ensure private enforcement of the law, I propose that the law provide certain form of one-way fee shifting rule. One-way fee shifting rule that I propose should ensure that fees only be shifted to the plaintiff when the plaintiff wins, but no fee be shifted when the defendant wins. Also, the plaintiff should be awarded fees even when the defendant moots the case by removing the alleged barrier after the plaintiff files the case. I argue that this rule will provide more incentive to enforce the law more vigorously.
