법률이 보장하고 있는 실체적 권리를 실질적으로 보장하기 위한 절차적 보호장치의 확보는 정의실현의 요체이며, 실체적 권리는 그 실현을 위한 절차적 보호가 완비되었을 때 비로소 완전한 보장이 가능하다.이에 본 연구는 한국의 특수교육진흥법상 장애아동의 권리에 대한 절차적 보호가 불완전하다는 인식 하에, 보다 정교한 절차적 보호장치를 규정하고 있는 미국의 장애인교육법상 절차적 보호장치에 대한 검토를 함으로써 한국의 법제도의 문제점을 적시하고 그 개선방향을 모색하고자 하였다.
Abstract
Procedural safeguards for the substantial rights provided by a nation's Constitution and laws are keys for the embodiment of legal justice. Substantial rights can be satisfactorily provided only with procedural safeguards against infringement upon them. The procedural safeguards for children with disabilities in Korean special education law are very simple and unsatisfactory for the rights of children with disabilities to education. In contrast, the special education law of US, the Individuals with Disabilities Education Act (IDEA) revised on December 3rd, 2004, has elaborate safeguards for them. This paper examines the procedural safeguards for the rights of children with disabilities in the IDEA of America, and the recent changes to the Act, and considers the drawbacks of procedural safeguards provided by Korean law, and suggests possible changes for the Korean system.
