유럽연합 디지털 정책의 동향과 전망: “유럽의 디지털 미래” · “유럽 데이터 전략” · “인공지능 백서”의 주요 내용과 의의

초록

2020년 2월 19일 유럽연합 집행위원회는 향후 5년간 유럽연합 디지털 정책의 방향과 대원칙을 밝히는 세 가지 정책 문서를 발표하였다. 첫째는 “인공지능 백서(White paper on AI)”, 둘째는 “유럽 데이터 전략(European Strategy for Data)”, 셋째는 “유럽의 디지털 미래(Shaping Europe’s Digital Future)”다. 이들은 그 자체로 법적 효력을 갖는 것은 아니지만, 집행위원회는 사실상 입법제안권을 독점하고 있는 기관으로서 그의 정책 문서는 향후 입법으로 이어질 가능성이 크고, 유럽연합의 법제는 우리나라는 물론 국제적으로도 영향력이 크다는 점에서 각별한 주의를 기울일 필요가 있다. 이러한 배경에서 이 글은 세 문서의 배경과 주요 내용 및 의의를 검토하고 있다. 여러 내용 중에서도 필자는 특히 디지털 규제의 관점에서는 특히 경쟁법의 개정, ‘데이터 법(Data Act)’과 ‘디지털 서비스 법(Digital Services Act)’의 도입, 인공지능 리스크 규제 체계의 개편 등이 중요하고 이들의 논의가 어떻게 귀결되는지에 대해 계속적으로 주시할 필요가 있다고 보고 있다. 디지털 플랫폼에 대한 경쟁법 집행과 관련 규제, 데이터 보호, 인공지능 등은 지금도 유럽연합이 전 세계에 강력한 규제 영향력을 행사하고 있는 분야들로서 향후 우리나라의 규제 체계에도 미칠 효과가 결코 적지 않을 것이기 때문이다. 필자는 이 글을 통하여 경쟁법의 개정, ‘데이터 법(Data Act)’과 ‘디지털 서비스 법(Digital Services Act)’의 도입, 인공지능 리스크 규제 체계의 개편 등 예상 가능한 제도적 변화에 대한 이해를 높이고 궁극적으로 우리 정책에 대한 시사점도 찾을 수 있기를 기대한다.

Abstract

On 19th February 2020, the European Commission released seminal papers that shape the block’s digital policy: the White Paper on AI, the European Strategy for Data, and the Shaping Europe’s Digital Future. These documents, albeit with no legal effect, are worth paying attention, given the European Union’s increasing willingness to regulate the digital platforms and the AI industries and its, not de jure but de facto, global regulatory power today. Against this backdrop, this paper explores the papers’ background, context, and main proposals on the digital platforms and AI industries with the aim of finding legal and regulatory implications for Korea’s regulatory framework governing data practices, digital platform businesses, and AI applications. Through this, the author aims to contribute to the establishment of a sound regulatory framework for digital markets in South Korea.
