공동체에게 주어진 정책문제를 해결하기 위해 그럴듯하고 적절한 정책대안을 설계하듯이 정책문제해결기구도 그럴듯하고 적절하게 설계되어야 한다. 본 연구는 주어진 정책문제를 해결하기 위해 새로운 정책문제해결기구를 구성하여야 할 때, 그것이 어떠한 설계와 제도화 과정을 거치는가를 분석한다. 특히 본 연구는 단일한 설계자가 아니라 상충하는 요구를 가진 다수의 이해당사자 조직들이 공동의 설계자로 참여하는 정책문제해결기구의 설계와 제도화 과정에 초점을 맞추어 분석한다. 상충하는 요구를 가진 이해당사자들이 공동의 설계자로서 참여하는 새로운 문제해결기구의 설계와 제도화 과정을 분석하기 위해 김대중 정부 시기의 노사정위원회 설계와 제도화 과정을 연구대상으로 선정하였다. 분석결과 노사정 각 주체들은 문제해결에 대한 사회적 관심과 예상되는 귀결에 따라 적절성의 논리(logic of appropriateness)와 함께 귀결성의 논리(logic of consequentiality)에 따라 상호조절 과정을 거쳐 노사정위원회의 제도적 규칙을 설계하였음을 확인하였다. 노사정 각 주체들은 상호조절을 통해 제도적 규칙들 속에 거부지점들(veto point)을 배치함으로써 치명적인 위험을 회피하는 전략을 선택하였다. 그 결과 노사정위원회는 임의기구에서 법령기구로 법적 위상을 높임으로써 제도적 안정성은 높아졌지만, 문제해결능력은 저하되는 모순적 제도화 과정을 보이고 있음을 확인하였다.
Abstract
The purpose of this study is to describe the process of design and institutionalization of a new policy problem solving organization. As the democratic policy problem solving organization, the Korea Tripartite Commission is constructed based on the initiative of the government and the agreement of the labor and business groups in order to overcome the national crisis in late 1997. Through this case study, we could recognize some inconsistent and contradictional characteristics of the process of design and institutionalization of the Korea Tripartite Commission. First, the participants in designing who had conflictual demands, struggled to posit veto points in institutional rules and procedure. That is for protecting their interests in matter of the expected consequences from the policy problem solving. These veto points resulted in weakening the problem solving capacity of the Korea Tripartite Commission. Second, the process of design and institutionalization of the Korea Tripartite Commission showed the contradictional characteristics between 'institutionalization stream of maintenance-strengthening' and 'de-institutionalization stream of weakening-abolishment'. That means that the process of design and institutionalization of a new policy problem solving organization is not progressing in only one stream line but simultaneously both of them, therefore it could be named as 'contradictional institutionalization' process. The results of this study are expected to be used as conceptual framework for future studies about design and institutionalization of a new policy problem solving organization.
