Abstract

The maritime geography of the Arctic Ocean and its jurisdiction are under the International Maritime Regime(UNCLOS) adopted in 1982. However, since Svalbard previously governed by a multilateral treaty caused new problems by the United Nations Convention on the Law of the Sea(UNCLOS). The paper examines these problems of Svalbard which has been the subject of jurisdictional conflicts since its discovery in the 16th Century. Svalbard is under Norwegian sovereignty as it is, yet its governance is under the international law. This paper will analyze the multilateral treaty that defined Svalbard’s jurisdictional status and the way how Svalbard is governed today. Norway’s sovereignty over Svalbard must be continually reasserted through its economic activities, national legislation, and international cooperation. Meanwhile, Russia is also set to reinforce its advantages over Svalbard’s jurisdiction. Although the Spitsbergen Treaty set a legislative multilateral framework for the ‘Svalbard question’, the question itself remains unresolved. Since Svalbard has increasingly become subject to strategic concerns related to the Arctic. Norway and Russia may be engaged in the same old battles in Svalbard, but in new ways. As far as these two countries are concerned, the consolidation of their national rights in Svalbard is necessary for denying other states the strategic benefits that hegemony over Svalbard could potentially give. Svalbard has long been a focus of interest and a subject of study from the perspectives of the international law of the sea and governance of the Arctic. In the future, the Svalbard islands also deserves greater attention for the way in which multilateral community develop by its residents and the states that support them.
