최근 북극해 및 북극 지역에 대한 국제사회 및 국가들의 관심이 증가하고 있다. 국제사회는 해양법 분야를 중심으로 북극과 남극 지역에 공통적으로 적용되는 IMO Polar Code와 같은 국제법을 발전시키고 있으나, 각 지역에 적용되는 국제법도 등장하고 있다. 북극 지역의 국제법은 비교적 짜임새 있는 이른바 남극조약체계와 달리 다자간 규율체계가 부족하고, 북극이사회를 중심으로 논의하여 개별 국가들이 체결하는 조약들이 많다. 남극 지역과 북극 지역에 관한 국제법의 법원과 규율방식이 다른 특성을 가지기 때문에, 법제간 조화를 통해 규범의 차이를 줄이고 국제사회의 의견을 조화시키는 노력이 필요하다. 북극 지역에 대한 중요성이 증가하고 있는 상황에서, 스발바르 조약과 같이 전통적으로 인접 국가들이 이 지역에 대한 국제사회의 문제의식을 이끌고 국제법 형성과 국내법 구축이 추진되었다. 한국은 과거 북극해와 북극 지역을 포함한 극 지역에 대한 관심이 많지 않았으나, 최근 국제사회의 이해관계가 증가함에 따라서 능동적으로 대응하려는 정책을 강화하고 한다. 한국이 남극조약 체계에 가입하면서 남극활동법을 제정한 것이 극 지역에 관한 본격적인 국내법 제정의 시작이라고 평가할 수 있는데, 최근에는 북극 지역까지 포괄하는 극지활동진흥법이 발효되었다. 그러나 극지활동진흥법이 가지는 여러 문제점도 발견할 수 있으며, 여전히 이 분야의 국내법 보완이 필요하다. 북극해 및 북극 지역에 관한 국내법의 보완을 위해서는, 국제법과 국내법의 조화 및 국내법 사이의 정합성 등을 고려하는 더 많은 고민이 요구된다.
Abstract
The international community and countries' interest in the Arctic region continues to increase due to geopolitical issues. This area is a repository of future resources and a space of opportunity, but also the region that various conflicts and problems are occurring. Since the Arctic discipline system in the international society has different features from the Antarctic discipline system, it is necessary to reduce differences in norms and harmonize opinions from the international community through the harmonization of the regulations on the polar regions. With the increasing importance of the Arctic area, some neiboring countries adjacent to this region have traditionally pursued effective policies by leading the international community's awareness of the area with their domestic laws. Korea had been far from the international situation for a long time. However, as interests in the area gradually increase, active policies are being implemented, as a result, the Polar Activities Promotion Act took effect in 2021, and sub-norms have been established accordingly. This paper examines the international laws on the Arctic region and analyzes the recently enacted Korean laws. In particular, it examines the provisions of the laws and discusses methods to harmonize between the international and domestic laws on the Arctic area.
