Abstract

In democratic societies governed by the rule of law, public participation and communication in the legislative process are essential. As emphasized by the OECD, ensuring the public’s access to information and opportunities for engagement in policymaking is fundamental to enhancing both the legitimacy and societal acceptance of legislation. This study examines the Public Comment Procedure in Japan as a representative model of institutionalized public consultation in government-led legislation. It analyzes the structural design and operational practices of the system and compares them with the corresponding mechanisms in Korea to identify key policy implications. In addition, it explores how both countries are responding to the shared challenge of expanding online participation in the digital era, with a particular focus on institutional approaches to fostering effective and inclusive civic engagement. In Japan, public consultation in the legislative process generally occurs through expert committees, regulatory impact assessments, and the Public Comment Procedure, which was formally established by a 2005 amendment to the Administrative Procedure Act. Among these, the Public Comment Procedure holds particular significance and is implemented more systematically than its Korean counterpart. Under this system, government agencies are required to publish draft legislation and supporting materials in advance, solicit public input for a minimum of 30 days, and disclose how the submitted feedback was reviewed and considered. The procedure consists of four stages—public notice and submission of public comments, review of feedback, and publication of results—with all stages publicly accessible via an online government portal. In Korea, government-led legislative process consists of several stages—such as legislative planning, pre-announcement of legislation, regulatory review, examination by the Ministry of Government Legislation, and deliberation by the Cabinet— with public consultation incorporated from the early stages of policy design. Members of the public may suggest legislative changes or engage in the drafting process in collaboration with relevant stakeholders. Feedback collected at this stage is disclosed through the Regulatory Impact Analysis (RIA) report, and additional public consultation is conducted during the pre-announcement period. However, the current system exhibits several limitations: public comments are often limited to simplistic expressions of opposition, feedback is not consistently communicated or addressed, RIA reports tend to lack sufficient detail, and comprehensive, post-consultation disclosure remains insufficient. This study aims to explore institutional reforms that can strengthen the practical impact of public participation in legislative processes, based on comparative insights drawn from Japan’s more structured and transparent consultation framework.
