Abstract

This paper examines the legal tension between the principle of legal certainty in voluntary real estate auction procedures and the restitution of unjust enrichment, with a focus on recent rulings by the Korean Supreme Court and comparative analysis of German and Japanese legal systems. In particular, Supreme Court Decisions 2018Da205209 and 2023Da228107 provide concrete guidelines on the extent to which legal reliability (Glaubwürdigkeit) should be recognized in auction procedures and the permissible scope of canceling or nullifying auction results due to procedural defects. While the doctrine of legal certainty is essential for protecting transactional security and ensuring the rapid transfer of rights, this paper argues that the unconditional exclusion of restitution claims in all cases—especially those involving serious procedural flaws or substantive unfairness—may unjustly infringe upon the rights of affected parties. This study classifies the requirements for claiming unjust enrichment under Korean law and systematically reviews the relevant jurisprudence, with particular emphasis on how courts have defined “serious defects” in execution titles or auction processes. Furthermore, it conducts a comparative legal analysis of German law, focusing on Sections 812 et seq. of the BGB and key rulings of the Federal Court of Justice (BGH), which recognize exceptions to restitution based on good faith acquisition and the protection of legal traffic. The paper also reviews the Japanese Civil Execution Act and the Supreme Court’s limited recognition of post-auction remedies for unlawful or materially defective enforcement procedures. Both German and Japanese legal systems adopt a principled stance on auction reliability but permit restitution or reversal in exceptional cases to preserve substantive fairness and due process. This study thus argues that Korea’s auction system should adopt a more nuanced approach to unjust enrichment claims, incorporating interpretive criteria that balance public confidence with remedial flexibility. In addition, legislative improvements to the Civil Execution Act are proposed to enhance procedural transparency and allow targeted judicial review in cases of manifest illegality or injustice. Finally, this paper reflects on the growing internationalization of real estate investment and underscores the importance of harmonizing auction reliability with substantive legal protections, particularly in a global legal environment where foreign investors demand higher institutional predictability. The findings are intended to provide practical guidance for courts, legislators, and practitioners, and to contribute to the development of a fairer and more consistent legal framework for real estate auctions in Korea.
