칠레 교육개혁 정책의 변화와 신헌법

초록

칠레 교육 제도의 가장 큰 문제는 교육이 1980년 헌법에 의해 만들어진 신자유주의적 시장 논리에 의해 지배되고 있다는 것이다. 1980년 헌법은 시민들의 ‘교육받을 권리’보다 사립학교와 학부모가 누릴 수 있는 ‘교육의 자유’를 더 적극적으로 보장했다. 그 결과 공교육이 약화되고 민간 부문이 교육 시장을 장악하게 되었다. 이런 상황에서 국가는 교육에 적극적으로 관여하기보다는 보조금을 지급하는 '보조 국가'라는 소극적 역할에 머물면서 교육 분리와 공교육 약화 등의 왜곡이 빚어졌다. 2006년과 2011년의 학생 시위는 신자유주의 교육 제도를 근본적으로 변화시키고자 했다. 그러나 일련의 개혁 방안들은 본질적인 변화보다는 신자유주의적인 교육의 틀을 유지하면서 그간 나타난 문제점들을 바로잡는 방식을 선택했다. 이런 교육 개혁 방안에 만족하지 못한 학생과 시민사회는 제헌국회 소집과 신헌법 제정을 요구하게 되었고, 제헌의회에서 절대 다수 의석을 확보하게 된다. 이들은 신헌법 초안에서 기존 헌법에 명시된 ‘교육의 자유’와 ‘교육받을 권리’를 새롭게 규정하면서 피노체트 시기의 유산에서 벗어나고자 했다. 결국, 신헌법에서는 ‘보조 국가’에서 ‘사회적 국가’로의 변화가 가시화되었고, 교육 분야에서는 국가의 역할을 강화하면서 신자유주의적 교육 정책과의 구조적인 단절이 명시되었다. 이 논문에서는 칠레의 교육정책 변화와 신헌법 초안의 교육 관련 조항을 살펴보면서 향후 칠레의 교육정책 방향에 대해 살펴보고자 한다.

Abstract

The fundamental problem with Chile's education system is that education is dominated by the neoliberal market logic created by the 1980 Constitution. The 1980 Constitution more actively guaranteed "freedom of education" that private schools and parents could enjoy than the "right to education" of citizens. As a result, public education weakened and the private sector dominated the education market. In this situation, the state remained in a passive role of subsidizing rather than actively engaging in education, resulting in distortions such as separation of education and weakening of public education. The student demonstrations in 2006 and 2011 attempted to fundamentally change the neoliberal education system. However, a series of reform measures have chosen to correct some problems while maintaining the neoliberal framework of education rather than essential changes. Students and civil society who were not satisfied with these educational reform measures demanded the convocation of the Constitutional Assembly and the enactment of the new Constitution, and secured an absolute majority of seats in the Constitutional Assembly. Those who wanted to fundamentally change the existing education policy tried to eliminate the legacy of the Pinochet period by newly defining the "freedom of education" and "right to education" of the existing constitution in the draft of the new constitution. In the end, in the new constitution, the change from 'subsidiary state' to 'social state' became visible, and structural disconnection from neoliberal education policy was specified while strengthening the role of the state in the field of education. In this paper, we will examine Chile's educational policy direction in the future by examining the changes in Chile's educational policy and the provisions related to education in the draft of the new constitution.
