4차 산업혁명이라는 표현은 널리 사용되고 있으며 그 의미도 다양하게이해되고 있다. 4차 산업혁명을 둘러싼 법적 문제에 대한 연구도 다양하게 진행되고 있으나 보통 인공지능이나 자율주행자동차, 사물인터넷, 3D 프린터 등의 세부적인 신기술의 소개나 그 규제방안에 대한 논의가 주를이루고 있다. 신기술의 규제를 위한 행정법의 대응을 산업혁명사를 통해살펴보면 대상이 되는 기술의 차이는 크지만 법적 관점에서는 전통적인위험방어에서부터 시작하여 규제전략의 다층화나 국제협력 요구와 같은오늘날 논의되는 내용과 크게 다르지 않다. 따라서 4차 산업혁명의 법적문제를 논하기 위해서는 신기술의 규제라는 문제를 넘어 전환기 행정법의 관점전환을 가져오는 단서개념을 포착해야 한다. 본 연구는 이를 위하여 단서개념으로서 디지털화를 전제하고 디지털화로 인해 변화하는 행정법의 문제를 적응능력, 조종능력으로 크게 나누어 개관하고 세부적으로는데이터 유통과 정보보호 및 보안, 임무이행방식의 변화 등을 소개하였다.
Abstract
The term "fourth industrial revolution" is widely used and its meaning is understood in various ways. Research on legal issues surrounding the fourth industrial revolution is also being conducted in various ways, but usually, the introduction of detailed new technologies such as artificial intelligence, self-driving cars, the Internet of Things, and 3D printers, or discussions on their regulatory measures. Looking at the response of administrative laws to regulate new technologies through industrial revolution history, the difference in technologies subject to them is large, but from a legal perspective, it is not much different from what is discussed today, starting with traditional risk defense and demanding regulatory strategy multilayered or international cooperation. Therefore, in order to discuss the legal issues of the fourth industrial revolution, we should go beyond the issue of regulating new technologies and capture the concept of clues that bring about a shift in perspective of the transitional administrative law. For this purpose, this study provided the premise of digitalization as a clue concept, opened the administrative law's changing problems due to digitalization largely by dividing them into adaptability and control capabilities, and introduced in detail the distribution of the operators, information protection and security, and changes in the method of mission execution.
