청소년 음주운전에 대한 우리나라의 현행법상 규정과 향후 대응방안

사회적, 정서적으로 취약한 시기인 청소년기에 유해물질인 주류를 섭취하게 되는 경우청소년의 신경학적, 신체적, 정서적 건강에 영향을 미칠뿐만 아니라 공격성이 외부에 발현됨으로써 타인에게 해를 입히거나 위험을 가할 가능성이 높으며 이러한 위험은 결국 사회적, 경제적 위험으로 귀착된다. 그리고 청소년이 청소년유해약물에 해당하는 주류를 마신뒤 무면허음주운전 혹은 음주운전을 행하는 사건도 적지 않게 발생하여 그 피해 또한 문제되고 있다. 우리나라의 현행법제는 만 19세 미만의 미성년자를 청소년보호법상의 청소년으로 정의하고 있고, 이들을 대상으로 청소년유해약물에 해당하는 주류를 판매하는 등의 행위를 금하고 있다. 도로교통법은 술에 취한 상태에서의 운전을 금지하고 있고, 만 18세 미만의 자는자동차 운전면허를 받을 수 없도록 규정하고 있다. 이러한 미성년자가 음주운전 중 타인의신체나 재물에 손해를 가하였다면 이러한 행위는 민법 제750조의 불법행위책임을 부담하는 외에 그 감독자의 주의의무 위반에 대한 불법행위책임 문제가 거론될 수 있다. 미국의 경우 운전면허 취득이 가능한 연령이 우리나라보다 낮지만 음주의 경우에는 만21세에 이르기까지 금주하는 주가 상당하며, 음주가 금지된 연령에 해당하는 자가 음주운전을 하여 사고를 야기한 경우에 그에 대한 처벌을 매우 강화하고 있다. 이러한 미국의 청소년 음주운전에 대한 제도를 검토하여 음주를 금지하는 연령을 어떻게설정할 것인지, 음주가 금지된 청소년에 대하여 어떠한 제재를 가할 수 있는지, 음주가 금지된 청소년의 음주운전에 대하여 어떻게 책임을 부과할 것인지에 관하여 그 시사점을 확인할필요가 있다.
Abstract
Alcohol consumption in adolescence, a period of social and emotional vulnerabilities, affects the neurological, physical, and emotional health of adolescents. Moreover, as aggression is expressed externally, a high possibility of harming others exists, eventually leading to social and economic risks. Another problem is unlicensed drunk driving or juveniles driving after drinking alcoholic beverages that are classified as harmful drugs for youth. These drunk-driving incidents occur frequently, causing much damage. Current South Korean legislation, specifically the Juvenile Protection Act, defines a juvenile as a person under the age of 19. The Juvenile Protection Act also prohibits selling alcoholic beverages that are classified as harmful drugs to juveniles. The Road Traffic Act prohibits driving while intoxicated, and a person younger than 18 years of age cannot legally obtain a driver’s license. If a juvenile causes harm to the body or property of another person while driving under the influence of alcohol, such an act will not only require compensation for damages arising from the unlawful act under Article 750 of the Civil Act, but it will also increase the liability for the juvenile’s supervisor’s breach of the duty of care. In the United States, the age at which a driver can obtain a license is lower than Korea, but many states prohibit drinking alcohol until 21 years of age and are strengthening the punishment for those who are prohibited from drinking alcohol and cause accidents because they drove drunk. The juvenile drunk driving system in the U.S. should be reviewed to identify the implications of setting a minimum age requirement for drinking alcohol, the sanctions that can be imposed on juvenile offenders who drink alcohol, and how to impose liability on juvenile drunk driving offenders.
