Abstract

The basis of the Korean policy towards migrants can be said to be statism and exclusive nationalism characterized by ① assimilation and selective reception of marriage migrants and migrants of Korean origin, and reception of highly skilled labor, and ② control and exclusion of low-skilled labor and undocumented migrants. In international legal approach towards human rights of migrants, the principle of prohibition of discrimination is not only an important international human rights standard but it also has the status of an international customary law, and even jus cogens. For this principle of prohibition of discrimination to have a meaning in reality, there have to be some special protection measures for migrants in relation to the concept of 'vulnerability'. Besides, it should be made clear that international human law is based on states' consent and therefore states have legal responsibility to protect migrants' human rights. It also has be to emphasized that “state sovereignty in immigration control" is only related to immigration itself, and discrimination and human rights violations of migrants in reality have nothing to do with “state sovereignty”. Even though migrants are recognized as the subject of basic rights through the interpretation of Constitutional Law, the Korean law and institution is based on complete discrimination and exclusion of migrants. The Korean law and institution excludes undocumented migrants from the scope of migrants, guarantee workers' rights to only small number of people among migrants. Multi-culture is being understood as the concept subordinate to the Korean culture, discrimination against marriage migrants and indigent migrants of Korean origin is being protected by law. Concerning administrative procedural guarantee and the protection of physical freedom, law justifies extreme discrimination. Unlike most other countries, all the migrants do not have the right to political expression, and only 'the principle of reciprocity' is applied to the remedies against states' illegal acts and general crimes. Migrants are under constant surveillance by all public institutions including schools and hospitals, and the right to education and family unification of undocumented migrant children is readily denied. The present law and institution, and perception towards migrants needs fundamental review and proactive reform is desperately needed.
