한국의 이민자 권리 변화에 관한 연구: 이민자 권리의 조건부를 중심으로

초록

한국사회에서 지난 20여 년간 법제도상의 이민자 권리 또는 사회적 통합은 지속적으로 진전되었음에도 불구하고, 이민자가 경험하는 사회적 차별과 배제는 크게 해소되지 않고 있다. 단순히 법제도상의 권리와 실제 간의 괴리 차원을 넘어, 본 연구는 법제도적 차원에서 여전히 이민자들에 대한 차별적 배제의 요소가 존재하지 않는지, 그리고 그렇다고 한다면 어떠한 방식으로 이루어지고 있는지 등에 대해 논하고자 하였고, 이민자 권리의 조건부 개념을 통해 관련 정책변화를 체계화·범주화하여 분석하였다. 구체적으로, 본 연구는 이민자 권리와 관련한 주요 정책변화가 나타난 2000년대 초반부터 2010년대 중반까지의 기간 동안 한국사회의 주요 이민자 집단인 결혼이민자와 일반(비동포) 저숙련 이주노동자, 그리고 동포 이주노동자 등의 권리 변화에 초점을 두고, 이들 집단의 권리 혹은 사회적 통합(배제)에 영향을 미친 정책변화를 분석하였다. 분석 결과, 세 이민자 집단의 권리 모두 범주조건(이민자의 법적 지위)과 사정조건(출입국 및 거주, 장기거주, 복지수급) 차원에서 점차 향상되고 있는 것으로 나타났다. 그러나 결혼이민자와 동포 이주노동자에 비해, 일반 이주노동자가 경험하는 사회적 통합의 진전은 상대적으로 요원한 것으로 판단된다. 범주조건(이민자의 법적 지위)과 사정조건(출입국 및 거주, 장기거주, 복지수급)의 완화에도 불구하고, 그동안 강화된 행동조건(행동, 활동, 관계)이 실제 이들이 진전된 권리를 사용하는데 실질적인 제한이 되고 있기 때문이다. 이러한 결과는 같은 기간 동안 결혼이민자나 동포 이주노동자의 행동 조건이 다소간 완화되거나 적어도 강화되지는 않은 것과 상당히 대조적이다.

Abstract

Over the last two decades, although the rights or social inclusion of immigrants has legally improved in South Korea, the degree of social discrimination and exclusion experienced by themselves has not significantly diminished. Going beyond the discrepancy between formal rights and their praxis, this study discussed whether and how immigrants are still discriminated and excluded on a legal aspect. using the conceptual framework of the conditionality of immigrant rights. Specifically, it focused on policy changes relating to the rights of three different immigrant groups—i.e., (female) marriage migrants, low-skilled labour migrants and ethnic Korean labour migrants—during the period between early 2000s and the mid-2010s. The analysis of this study argued that the rights of all the three immigrant groups have gradually improved in terms of conditions of category (in relation to immigrant's legal status) and conditions of circumstance (in relation to their entry/residency). However, it is noteworthy that the degree of social inclusion experienced by low-skilled labour migrants may not significantly be ameliorated. Although low-skilled labour migrants' conditions of category and circumstance have eased, the exercise of their improved rights has substantially been restricted by the tightened conditions of conduct (in relation to their behaviours, activities and relations). This is in considerable contrast with marriage migrants and ethnic Koreans whose conditions of conduct have eased to some extent—or at least not been tightened.
