Abstract
Modern military technology has become a core element of national security, and its protection requires legal responses that go beyond mere technological safeguards to encompass strategic national interests. This paper undertakes a comparative analysis of the U.S. legal frameworks governing the protection of classified military information, focusing on the Espionage Act of 1917 and the Economic Espionage Act of 1996. It examines the legislative background, protected interests, elements of offences, scope of application, and differences in investigative and prosecutorial approaches under the two statutes, demonstrating how they form a complementary system to address the leakage of military technology. The Espionage Act primarily targets government-classified information, prioritizing confidentiality and national security over public interest or freedom of expression, thereby imposing criminal liability for disclosure. In contrast, the Economic Espionage Act protects private-sector trade secrets, criminalizing the theft of proprietary technology and information for the benefit of foreign governments or competitors. Case law analysis confirms that while the Espionage Act regulates the leakage of public secrets, the Economic Espionage Act governs the misappropriation of private technological information, thus operating as functionally differentiated rather than substitutive frameworks. This study further considers the implications for South Korea, where the Military Secret Protection Act and Industrial Technology Protection Act operate in a fragmented manner, and trial procedures lack sufficient safeguards for classified information. Drawing on the U.S. model, key reform directions include the introduction of a CIPA-style procedure for handling classified trials, a dual-track regime distinguishing military and industrial secrets, the specialization and coordination of investigative authorities, and clearer statutory definitions of protected information. By analyzing the tension between safeguarding military technology and preserving information freedom, this paper highlights both the role and the limits of criminal law, while offering comparative insights for strengthening South Korea’s legal framework for technology security.
