북한의 「사회보험 및 사회보장법」에 대한 분석

초록

본 연구의 목적은 북한의 「사회보험 및 사회보장법」의 법적 정체성을 규명하는 것이다. 본 연구 서술순서는 먼저 ① 입법 배경, ② 법적 의의, ③ 사회복지법제 위계의 변화를 고찰하였다. 다음으로 구조와 행위 차원에서 법적 구성과 행태에 접근하였다. 그다음으로 법령의 내용을 중심으로 ① 적용대상, ② 급여종류와 조건, ③ 재정, ④ 서비스 전달과 관리운영체계를 검토하였다. 마지막으로 「사회보험 및 사회보장법」의 함의와 쟁점, 평가를 하였다. 본 연구방법은 북한의 원전인 각종 법령의 조문을 중심으로 질적연구방법을 시도하였다. 분석결과, 첫째, 동 법령은 사회보험과 사회보장이 통합된 형태의 법령으로 제정되었다. 둘째, 북한이 기존의 복지운영체제에 대한 고민과 해결책을 포괄한 법령이다. 셋째, 이로 인해 기존의 사회보험과 사회보장 관련 법령 일부가 수정 혹은 폐기될 수밖에 없다. 넷째, 때문에 북한은 후속 법령을 신속히 제정하여 실천적 수준까지 법적 정비를 해야 하는 과제가 남아 있다. 다섯째, 동 법령 존재 자체가 북한 사회복지체제를 크게 흔들고 있다. 결국 지금 현재 북한 사회복지에 ‘김정은식 북한 사회복지의 변화와 개혁’이 제도적 차원에서 나타나고 있다.

Abstract

The purpose of this study is to identify the legal identity of North Korea’s Social Insurance and Social Security Law. The order of this study is as follws: First, we considered (1) the legislative background and (2) its legal significance. Next, we approached the legal composition and behavior of the statute in terms of structure and action. Next, we examineed (1) the subject of application, (2) the types and conditions of salary, (3) finance, and (4) the service delivery and management operating system, focusing on the contents of the law. Finally, the implications, issues, and evaluations of the Social Insurance and Social Security Act were made. The research method tried a qualitative research method centered on the text of various laws and regulations that are North Korea’s nuclear power plants. The result of the analysis is as follows: First, the decree was enacted as a form of decree in which social insurance and social security were integrated. Second, it is a decree that encompasses North Korea’s worries and solutions to the existing welfare management system. Third, this will force some existing social insurance and social security-related laws to be amended or scrapped. Fourth, North Korea remains to enact subsequent laws quickly and make legal improvements to the practical level. Fifth, the very existence of the law greatly shakes the existing North Korean welfare law system. Right now, “Kim Jong-un-style change and reform of North Korean social welfare” is emerging at the institutional level.
