북한 로동능력상실년금 제도와 실태에 관한 연구

본 연구는 북한 로동능력상실년금의 제도와 실태를 분석함으로써, 제도와 실태 간 일치성을 설명하고자 한다. 이를 위해 북한 법령과 사전에 기초하여 로동능력상실년금의 제도를 분석하고, 북한이탈주민에 대한 질적 인터뷰를 통해 실태를 파악하였다. 분석 결과, 완전일치성의 경우, 적용대상, 기여기간, 이중급여 불가의 원칙, 업무기인성과 업무불기인성으로 구분되는 직무관련성 원칙, 동사무소를 중심으로 한 전달체계이다. 부분일치성의 경우, 급여의 지역별 차이, 노동강도별·근속연한별·등급별 소득대체율이다. 완전불일치성의 경우, 제도상에는 존재하나 실제로는 부재한 폐질일시금이다. 일시금 제도를 제외하고 전반적으로 로동능력상실년금은 제도와 실태 간 일치성을 갖는다고 결론내릴 수 있다. 본 연구는 폐질년휼금과 로동능력상실년금이 동일한 제도라는 관계를 규명하고, 사회보장년금의 하위 급여로서의 로동능력상실년금에 대한 역사적 접근을 통한 문헌분석과 사전을 통한 깊이있는 텍스트 독해를 한다는 점에서 의의가 있다. 이를 통해 연구자들은 향후 남북관계 발전에 따라, 연구방법을 다각화하고 연구자료를 최신화함으로써 북한 제도와 실태 연구가 발전하기를 기대한다.
Abstract
The purpose of this study is to investigate the correspondence between the system and reality through the analysis of the system and actual condition of North Korean disability pension. To do this, we analyzed the documents based on North Korean laws and dictionaries, and interviewed North Korean defectors. The case of perfect consistency includes coverage, contribution period, the principle of double benefit, the principle of job relevance, delivery system based on district office. In the case of partial consistency, there are the regional difference in benefit and the replacement rate by labor intensity, the length of service, and disability grades. In the case of inconsistency, there is lump sum allowance of disability that exists only in the legal system while being absent in reality. This study suggests 1) an identical relationship between the disability pension and the disability insurance, 2) the disability pension as a sub-benefit of social security pension, and 3) an literature analysis based on a historical approach and deep text readings through dictionaries. We expect that this research of the system and actual condition in the North Korean disability pension will diversify the research methods and update research data for the development of inter-Korean relations in the future.
