한국방송공사(KBS)의 법적 지위에 관한 고찰: ＂공공기관 지배구조 혁신방안＂에 대한 비판적 분석을 중심으로

Abstract

In December 2005, Government introduced a plan to promulgated as the “Reform plan for public institutions”. The plan, however, makes me have a critical mind because the definition itself of public institution as the institution for determining what is government-invested organization even including KBS. But any legislative effort for defining or characterizing the public broadcasting, should be directed toward an analysis of constitutional Perspective. Because the legislative effort should be within the limit of constitutional value order. With the point that can distinguish public broadcasting system from government-invested organization and with respect to the function of public institutions, I want to confirm the legal status of KBS based on the“ the structure and function of public broadcasting system”and suppose to legal status of KBS at present. With this purpose in mind, I analyzed the constitutional value of broadcasting and two typical types of public broadcasting system with BBC in England and german public broadcasting system.
