이 글은 공영방송의 정상화를 위해 지배구조 개선이 필요하다는 문제의식 아래, 공영방송 지배구조 개선을 위한 이론적 전제와 개념, 그리고 제도적 대안을 제시하는 데 있다. 이를 위해 이 글은 지금까지 공영방송 지배구조 개선안이 기업지배 관점에 경도되어 보편적 관점의 논변을 제시하지 않았다고 비판한다. 또한 공영방송에 대한 법적 규정을 포함한 기본 작업이 이루어지지 않은 점도 지적한다. 특히 공영방송 정상화를 위해서 이론적 논의는 물론 실천적 고려가 필요함을 주장한다. 공영방송 지배구조를 이론적으로 정당화하기 위해서 (1) 공영방송이 정치와 불가분한 관계를 맺는다는 것, (2) 공영방송 이념을 현실화하는 작업은 어렵지만 불가피하다는 것, 그리고 (3) 공영방송 개념 자체가 변화해 왔다는 것을 먼저 검토한다. 이를 기초로 우리나라 공영방송 지배구조 개선을 위한 구체적인 방안을 공영방송 개념의 규정, 이사회와 사장 선임의 방법, 설명책임과 의무의 규정으로 구분해서 제시한다. 특히 ‘공공서비스 방송의무’를 먼저 규정하고, 그 의무를 수행하는 정도만큼 공영방송으로 규정할 수 있다는 방안을 주장한다. 마지막으로 공영방송 지배구조 개선을 위한 방법론으로 방송법 개정에 필요한 실천적 과제를 제시한다.
Abstract
This essay aims to provide theoretical background and policy agenda for the reform of the governance of public service broadcasting in South Korea. The pending bills for reforming the governance of public service broadcasting are critically examined in order to clarify the conditions under which public service broadcasters in South Korea can achieve de facto independence from the government as well as effective management of public service broadcasting. After discussing the arguments for the inseparability of public service broadcasting from political processes and the inevitability of pursuing the ideas and values of public service broadcasting in fractured civil society, this paper presents policy alternatives and institutional arrangement for reforming the governance of public service broadcasting in South Korea. In particular, an institutional and legal definition of public service broadcasting and the ways of constructing a governing board and the appointment of the president are presented.
