키케로의 「섹스투스 로스키우스 변론」은 법정연설의 귀감이다. 이 변론에서 키케로는 인간은 서로 연대해 용기로써 불의에 맞서야 한다고 강조한다. 그는 선량한 시민 로스키우스의 무죄를 설득하고 있는데, 이 과정에서 후마니타스의 개념이 구체적으로 드러난다. 크게 ‘인간다움’과 ‘인문학’의 의미로 사용되고 있는 후마니타스 가운데, 이 글은 전자의 의미에 주목한다. 보편이념으로서의 후마니타스 개념은 키케로가 특별히 강조하였을 뿐만 아니라 당시 로마사회에서 사회와 개인의 기본덕목이자 지향해야 할 최고선으로 기능했다. 그의 변론 전 과 정은 세 개의 물음에 대한 답이라고 할 수 있다. 첫째, 자신이 변호하려는 사람은 누구인가? 둘째, 자신이 상대해야 할 사람들은 어떤 사람인가? 셋째, 자신의 변론을 듣고 판단해야 할 심판인들은 어떠해야 하는가? 이 물음의 답을 구성하고 있는 궁극의 키워드가 바로 후마니타스다. 후마니타스는 한 사람의 인간으로 대접받고 보호받으며 살아가기 위해 지녀야 할 덕목이자 공동체의 일원인 시민이 갖추어야 할 기본 자질이다. 후마니타스는 삶의 실천과 교육을 통해 키우고 지켜나가야 하는 덕목으로 키케로 수사학의 길라잡이다.
Abstract
Cicero's "Pro Sextus Roscio" is an exemplar of court speeches for the forensic speech. In his speech, he emphasized that human beings must stand up for injustice with courage. He claims that Roscio, a good citizen, is innocent, and in this process, the concept of humanitas is revealed. Among the humanitas, which are used in the meaning of humanity and humanities, this article pays attention to the meaning of the former, and the concept of humanitas was not only emphasized by Cicero, but also practiced as the foundation of society and individual virtues in Roman society at the time. As the universal ideology the entire process of his pleading is the answer to the following three questions. First, who is he trying to defend? Second, who does he have to deal with? Third, who should be the judges who hear and judge his defense? The ultimate keyword that constitutes the answer to the questions is humanitas, a virtue that must be possessed in order to be treated and protected as a human being and a basic quality that citizens of a community have to possess. Humanitas is a signpost of Cicero’s rhetoric, a virtue that must be nurtured and protected through life practice and education.
