Abstract
In the name of Freedom of Speech under the First Amendment, from the beginning of the nation to the present in the United States, hate speech and hate crimes against Native Americans, black slaves, immigrants, religion, women, sexual minorities, and people with disabilities have continued. The development of the discussion on the limitations on freedom of speech will further clarify the concept of freedom of speech and increase the awareness of hate speech and hate crime. First, this article examines the American society’s position on policies on hate speech and hate crimes at the international level. Second, it explores various interpretations of speech and acts that define hate speech, and discusses the concept of ‘fighting words’. Third, it examines historical cases that define hate speech as ‘fighting words’ and ‘actual malice’, and explores the discussions on various regulations and punishments for hate speech. Fourth, it investigates the process in which ‘clear and present danger’ becomes the standard for the regulation of hate speech. Finally, it explores cases in which such hate speech leads to hate crimes, introduces examples of the types of statements in the hate crime standard proposed by the U.S. Department of Justice, and discusses its strengths and shortcomings.
