본 연구는 종교의 자유와 정교분리에 대한 토마스 제퍼슨Thomas Jefferson의 사상을 공화국에 대한 그의 사상의 콘텍스트에서 기술한다. 공화국에서 정치-종교의 관계는 중요하지만 동시에 아주 민감한 주제이다. 종교의 자유는 공화국이 추구해야 할 절대의 가치이다. 어떤 경우에도 종교의 국가주의는 배격되어야 하고, 이 점에서 국가와 교회 사이에는 '높고 견고한 분리의 장벽'이 구축되어야 한다. 동시에 공화국에서 국가와 교회, 정치와 종교는 본질적으로나 현실적인 면에서 완전히 분리될 수 없다. 특히 공화국은 이의 덕성을 위해 시민종교를 추구할 수 있는데, 이 과정에서 종교의 자유와의 충돌이 일어날 가능성이 높다. 종교의 자유와 공화적 덕성의 사이에 존재하는 이 본질적 모순을 어떻게 해소할 수 있는가? 토머스 제퍼슨은 두 가지 해답을 제시한다. 첫째는 공화적 덕성의 기초를 종교가 아닌 공화국의 경제적 삶에서 구하는 것, 둘째는 시민종교가 아닌 종교의 자유가 만들어내는 시민적 덕성에 주목하는 것이다. 그는 종교의 자유만 보장되면 국가가 개입하지 않더라도 ‘종교의 자유시장’이 공화국이 요구하는 자유, 관용의 덕성과 ‘참된 종교’를 생산해 낼 것이라고 주장했다. 다만 종교의 자유가 국가의 종교에 대한 절대 무관심과 불간섭을 의미하지는 않으며, ‘종교의 자유시장’을 보호하고 이를 활성화하기 위해 그리고 오직 이 한도 내에서 국가는 필요한 역할을 수행할 수 있다, 이를 통해 공화국은 종교의 자유와 공화적 덕성을 동시에 추구하는 것이 가능하고 국가와 교회, 종교의 자유와 공화적 덕성의 사이의 본질적 모순도 해소될 수 있을 것이라고 그는 생각했다. 종교의 자유, 정교분리가 거의 종교적 신념으로 추앙되면서 시민적 덕성과 공동체적 삶이 설 자리를 잃게 된 오늘날 공화국의 위기 속에서, 종교의 자유, 공화적 덕성의 공존과 이를 위한 국가-교회 관계를 고민한 제퍼슨의 사상적 노력은 충분히 평가 받을만하며 동 주제에 관한 우리의 사상적 노력에도 유용한 단초를 제공할 수 있을 것이다.
Abstract
The objective of this article is to discuss Thomas Jefferson’s thought on religious freedom and church-state relations in the context of his republican discourse. There is an essential paradox, it is argued, between the freedom of religion and the republican virtue in a republic. How would Jefferson answer to this critical question facing a republic? He proposes two answers: first, the republican virtue would be sought in the economic life of the republic, rather than in an enforced ‘civil religion’; secondly, we have to focus on the kind of republican virtue the freedom of religion is expected to produce. Republican virtue would be complete with the freedom of religion fully secured, without the state’s intervention to impose civil religion on society, thus the paradox of religious freedom and virtue in a republic being resolved, Jefferson argues.
