러시아 푸틴 대통령의 권위주의 통치와 삼권분립

푸틴의 권위주의 통치의 가장 중요한 특징 중 하나는 삼권분립 시스템이 사실상 와해되어 있다는 사실이다. 푸틴은 ‘초대통령제’라는 권력구조를 활용하여 다른 헌정기구의 상위에 존재하며 권력을 독점함으로써 입법부와 사법부의 역할을 제한하고 있다. 러시아 국민들 또한 전통적인 온정주의 정치문화로 인해 삼권분립보다는 푸틴 대통령에로의 권력 집중에 호의적인 태도를 보여 왔다. 푸틴이 집권하는 동안 정당정치가 미발전한 상태에서 친정부 정당인 통합러시아당은 권력정당과 패권정당으로서의 역할을 수행하였다. 그 결과 입법부는 푸틴 대통령과 행정부에 의해 사실상 장악되어 이들이 제출하는 법률안을 통과시켜주는 거수기 역할을 수행하는데 그치고 있다. 푸틴정부가 친정부인사를 재판관에 임용하고 ‘전화재판’과 같은 소비에트식 통제방식을 동원한 결과, 사법부는 ‘정치화’ 되어 푸틴의 권위주의 통치를 정당화·합법화하는 일종의 통치도구로 전락하였다. 푸틴의 권위주의 통치 아래서는 삼권분립 시스템의 정착을 더 이상 기대할 수 없다. 푸틴은 헌법수정을 통해 현대 러시아사에서 최장기집권을 도모하고 있다. 푸틴정부의 부정부패도 만연해 있다. 이러한 상황에서 러시아 체제변혁은 러시아 국민들의 몫으로 남아 있다. 최근 들어 다행스럽게도 시민사회가 저항적 성격을 띠면서 재활성화되고 있다. 러시아 국민들 스스로가 정치개혁의 목소리를 결집시켜 시민운동을 지속적으로 전개해 나간다면, 러시아가 권위주의 체제에서 벗어나 삼권분립이 보장되는 민주주의 사회로 전환되는 것도 불가능하지는 않다.
Abstract
One of the most important factors characterizing Putin’s authoritarian rule is the fact that the system of separation of powers has been in a state of de-facto collapse. Using the constitutional order called ‘superpresidentialism’, Putin has enabled himself to monopolize power dominating other constitutional institutions including the legislature and judiciary. Russian people, in the conventional paternalistic political culture, have also shown favor to the concentration of power to Putin than to separation of powers. During Putin’s years in power, United Russia, the pro-government party, has played a role of a party of power and hegemonic party with party politics in general undeveloped. As a result, the legislature has ended up being merely a rubber stamp for President Putin and his administration. Also, the judiciary, politicized by the administration using a soviet style control such as ‘telephone justice’, has become a kind of governing instrument legitimating Putin’s authoritarian rule. Under the rule of Putin’s authoritarianism, it seems separation of powers can not be expected any longer. Putin is planning to be in power longer than anyone else in Russia’s history by amending the constitution, while irregularities and corruption are prevalent in the government. In this situation, a possible regime shift depends solely on the people of Russia. Rebellious civil society, fortunately, has recently begun to revive itself. It would not be impossible for Russia to change to a democratic society with separation of powers secured as long as Russian citizens are determined to run active and unified civil movements calling for political reform.
