Abstract

This paper explores the case of Cha, Jin-young who were prosecuted for false allegation of sexual assault after her reporting the assault to police and seeking justice. The Korean criminal justice system found Cha, Jin-young not guilty on the false reporting of sexual assault charge on 30th August 2016. In identifying a genuine rape case or a false reporting of sexual assault, International Association of Chiefs of Police(IACP) provides sexual assault investigation guidelines. According to it, police officer or investigator should complete a thorough investigation and avoid labeling ‘false’ on the ground of initial victim interview or victim’s reaction. The guidelines also clarify that officer or investigator should provide a solid evidence based on a completed investigation if they charge a victim of sexual assault with false reporting. This article analyzes the case of Cha in accordance with best guidelines promulgated by IACP. As a result, the article demonstrates that both police and prosecutor failed to investigate the case of Cha because of their biases on rape and rape victims. Cha, jin-young was also disbelieved as a victim of sexual assault because she did not fit a victim stereotype. Cha was prosecuted in light of failing investigation rather reliable evidence after fully and properly completing investigation of sexual assault case. In this vein, this article argues that it is urgent to construct and implement best practices for investigating sexual assault victims. It also suggests that this is the best way to end unnecessary disputes surrounding the false allegation of rape.
