초록

한국사회에서 ‘억울한 남성 피해자’를 연상시키는 악의적 범죄로 우선적으로 통용되고 있는 성폭력 무고는 물론 ‘죄 없는 남성피해자’에 관한 것이지만, 조사과정에서의 성편견과 젠더규범에 의해 성폭력 피해자들이 또 다른 희생자가 되는 것을 의미하기도 한다. 또한, 성폭력 피해에 대한 무고의심은 성폭력 범죄가 수사되지 않는, 그리고 가해자 남성이 처벌받지 않는 조건을 만들어 내는 것이기도 하며, 실제 피해자들이 제대로 된 법적 보호와 조치를 받지 못하는 것을 의미한다. 그리고 가장 중요하게는 성폭력 사건 그 자체, 성폭력 피해자와 가해자에 관한 대중적 담론의 구축에영향을 미치는 일이기도 하다. 이 글은 성폭력 범죄 엄단이 성폭력 무고사범에 대한경각심으로 쉽게 환원되는 사회적 태도를 환기하기 위해 성폭력 피해가 성폭력 무고의심으로 전개되는 과정의 비논리, 비합리, 성편견, 성차별적 젠더규범을 구체적으로 검토하였다. 성폭력 피해자를 성폭력 무고 피의자로 호명하는 그 절차와 과정이합리적 원칙과 철저한 기준에 의한 것인지를 비판적으로 검토하는 일은 성폭력 무고범죄에 의해 희생될 수 있는 모든 유형의 피해를 근원적으로 차단한다는 점에서 중요하다.

Abstract

In Korean society, the issue of false allegation of rape has been exclusively regarded as a genuinely innocent man who has been falsely accused. This paper, however, sheds light on the other side of false allegation of rape, which may lead to miscarriages of social justice by accusing a real rape victim. In this respect, the issue of false allegation of rape is a matter of creating conditions for impunity of perpetrators, and most importantly, the baseless fear of false rape allegations has constructed a dominant discourse of both perpetrators and rape victims, as well as rape itself. In order to challenge the widespread assumption that false complaints is all about a fabrication of rape allegation, this paper differentiates false allegations from lacking evidence, retracting allegations, and inconsistent allegations. Especially focusing on gender biases and norms, which are incorporated into the process and procedures of rape investigation, this paper argues for establishing and developing a reasonable and prudent principle and standard to investigate rape crimes.
