초록

2022년 3월 발족한 <성매매처벌법개정연대>는 한국 정부가 성매매여성은 처벌하지 않고 알선자와 매수자만 처벌하는 일명 ‘노르딕 모델’을 채택하도록 촉구했다. 2000년 대 초 「성매매처벌법」 제정 운동 과정에서도 한국의 페미니스트들은 동일하게 요구한 바 있다. 이 논문에서는 이처럼 같은 주장과 전략이 다른 결과, 곧 「성매매처벌법」의 금지정책이 아니라 노르딕 모델의 신폐지정책으로 귀결될 수 있을지 탐색하기 위해, 스웨덴과 한국의 성매매정책, 성시장 구조, 여성운동을 비교한다. 연구 결과, 스웨덴에서는 젠더 평등을 추구한 사민당 정부, 여성의원과 급진주의 여성운동의 연대, 국민의 압도적 지지, 그리고 성시장의 저발전으로 인해, 성매매가 여성에 대한 폭력으로 정의되고 「성구매처벌법」이 통과될 수 있었음을 확인했다. 반면 성시장의 규모가 상당하고 성매매가 여성의 범죄이자 노동으로 간주되었을 뿐만 아니라 국회가 여전히 보수적인 한국에서, 여성운동은 성구매자 처벌을 주장했으나 결국 기존의 금지정책과 타협했다. 그러므로 한국의 여성운동이 노르딕 모델에 대한 국민의 지지를 확보하고 국회 및 행정부에 대한 협상력을 갖추며 경찰과 법원의 안정적 법 집행을 보장하지 못하는 한, 노르딕 모델의 이식은 요원해 보인다.

Abstract

The Solidarity for Revising the Act on the Punishment of Prostitution, established in March 2022, has demanded the Korean government penalize male clients and third parties while decriminalizing prostitutes by adopting the so-called ‘Nordic Model.’ Feminists in Korea made the same argument in the early 2000s during the campaign to legislate the Act on the Punishment of Commercial Sex Acts. This article conducts comparative research on prostitution policies, sex industries, and feminist movements in Sweden and Korea to explore whether employing the same argument and strategy of the past campaign can enable feminists today to achieve a different result, that is, adopting the Nordic model. The research finds that in Sweden prostitution was defined as violence against women and therefore the Sex Purchase Act was legislated, thanks to the Social Democratic government’s pursuit of gender equality, the solidarity between female lawmakers and radical feminists, massive public support, and the underdevelopment of the sex industry. In Korea, in contrast, the sex industry prevails, prostitution is considered a women’s crime and labor, and the National Assembly remains conservative. This context led feminists in Korea, who initially advocated for the Nordic model, to compromise with the existing grammar of prohibition. This article argues that transplanting the Nordic Model in Korea would be challenging, if not impossible. For this to happen, the Korean feminist movements need to garner public support for the model, gain the power to negotiate with the legislature and the administration, and guarantee consistent enforcement of rules by the police and court.
