「성매매처벌법」이 제정, 시행된 지 13년이 지난 시점에서 성매매가 범죄라는 인식이 확산되는 효과는 있었으나 그 이외 성매매, 성매매 알선자의 처벌이 많이 이루어져 성산업이 붕괴되고 있다거나 성매매피해여성의 인권에 대한 긍정적인 평가를 내리기는 쉽지 않은 상황이다. 「성매매처벌법」의 목적인 성매매와 성매매알선 등 행위의 처벌을 보다 효과적으로 집행하고성매매여성의 인권을 보호하기 위해서는 새로운 전략이 필요하다. 본 논문에서는 성매매 규율과 관련하여 성매매 수요차단 모델(소위 ‘노르딕 모델’)을 취하고 있는 국가인 아일랜드, 캐나다와 금지주의 국가인 미국의 일부 주의 입법례를 분석하고 우리에게 주는 법･정책적 함의를 얻어 성매매 알선 및 수요차단의 방향성 제시를 위한 법･정책과제를 제시해 보고자 한다.
Abstract
It has been thirteen years since the Act on the Punishment of Prostitution was established and implemented. The enactment has helped more citizens recognize sex trafficking as a crime. However, it is hard to say that the resulting strong punishment of sex trafficking and sex trade brokers has led to the collapse of the sex industry and an improvement in the human rights of female victims. Therefore, considering the basic purpose of the Act, new strategies need to be devised to more effectively punish sex trafficking and its arrangement and protect the human rights to female survivors. In connection with sex trafficking-related rules and regulations, this paper is designed to analyze the legal systems of Ireland and Canada adopting the Nordic Model for the prevention of demand for sex trafficking and of some states in the US where prostitution is prohibited, examine their implications on Korean laws and policies, and thereby identify legal and policy issues in order to present how to prevent the arrangement of and demand for sex trafficking.
