1995년부터 도입을 위한 논의가 시작된 법학전문대학원 제도는 우여곡절 끝에 2007년 7월 3일 법학전문대학원 설치ㄱ운영에 관한 법률안이 국회에서 가결됨으로써 2007년 7월 27일부터 시행되었다. 이에 따라 교육과학기술부장관은 2008년 2월 4일 법학교육위원회의 심의결과에 따라 설치인가를 신청한 41개 대학교 중에서 25개 대학을 법학전문대학원 설치 예비인가 대학으로 선정하고, 2008년 8월 29일 위 25개 대·학을 현지조사 등을 거쳐 법학전문대학원 설치인가대학으로 선정하였다. 이 논문에서는 대법원의 대상판결(예비인가거부처분취소청구사건) 및 그 원심판결을 분석하여 예비인가(내인가)의 법적성질, 경원자소송의 원고적격·제척사유문제, 사정판결의 위헌성 문제를 다루고 있다.
Abstract
The law school act was enacted in July 2007 in Korea. Afterwards The minister for education, science and technology selected 25 universities as preliminary permission beholders. After all the minister selected them as final permission beholders for law schools. This thesis is aiming at analyzing the decision of Korean supreme court and the decision of Seoul high court about the case of the rejection of preliminary permission for law school. The issues are the legal character of preliminary permission, standing problems in the competitioners' cases and the constitutionality of the exceptional decision for public welfare. The writer analyzes those problems, especially in comparison to german legal system and japanese legal system.
