개별화 교육계획 시행의 근거법령에 대한 한･미간 비교연구：과제와 개선의 대안

본 연구는 특수교육대상학생의 적절한 교육을 위해 실시･수립하여야 하는 개별화 교육(계획)과 관련된 쟁점을 검토하고 그 개선의 대안을 제안하는데 목적이 있다. 「2008년 개정 특수학교 교육과정」의 고시에 이어 2009학년도 시행을 앞두고 있는 시점에서 특별히 중요한 논제인 개별화 교육(계획)에 관한 법률 규정이 「장애인 등에 대한 특수교육법」의 제정으로 종전과 크게 달라졌기에, 신법의 규정을 구법의 규정과 법리적 측면에서 비교･검토하였다. 또한, 미국의 1975년, 1997년, 2004년 「장애인교육법」의 개별화 교육계획에 대한 규정을 살펴보았다. 이와 함께 한국과 미국의 개별화(교육)계획 관련규정을 비교하였다. 이를 통해, 한국의 특수교육현장에서 개별화 교육계획이 원만히 뿌리를 내리는데 필요한 사항과 문제점의 해결을 위한 대안을 제언하였다.
Abstract
The purposes of the present study were to examine the relevant issues of the individualized education plan (IEP) and to suggest the alternatives for its improvement. The IEP must be planned and implemented for the appropriate education for the students with special educational needs. It is one of the critical issues in special education field. Because the regulations on IEP radically changed due to the recent implementation of the Special Education Law and the Like and the notification and implementation of the 2008 Special School Curriculum, the study compared and discussed the previous and present regulations in terms of legal aspects. Also, the study examined the regulations on IEP of Education for All Handicapped Children Act (EHA) of 1975 and the Individuals with Disabilities Education Act (IDEA) of 1997 and most recently 2004 in USA. Based on these comparison and discussion, the study suggested the alternatives necessary in implementing IEP appropriately in special education settings in Korea and solving its problems.
