본 논문은 학부모 학교 참여 법제의 국제 비교를 위한 연구 중 독일의 법제를 소개하고 분석하기 위하여 작성되었다. 독일은 연방제 국가이며, 교육과 관련된 입법관할은 주(州)에게 있기 때문에 각 주(州)마다 상이할 수밖에 없다. 하지만 함부르크 합의를 기초로 독일연방 전체의 교육과정 및 제도의 보편성을 확보하기 위해 노력하고 있기 때문에 본 논문에서는 바덴뷔르템베르크(Baden-Württemberg) 주(州)의 공립학교를 중심으로 독일의 학부모 학교 참여 법제에 대해 소개하고 분석하였다. 독일에서는 학부모의 학교 참여의 내용과 한계 그리고 그 방식에 대해 법령으로 비교적 상세하게 규율하고 있다. 특히 학부모회를 통한 학교 참여가 보편화되어 있는 것으로 파악되며, 이를 통해 학부모 이익의 현실화가 이루어지고 있다.
Abstract
This paper was written to introduce and analyze the German legal system relating to parental contributions to schools. Germany is a federal state. In addition, according to Basic Law for the Federal Republic of Germany, legislative authority in the field of education lies with the Länder, so each Land has different education laws. However, due to the Hamburg Agreement, the curriculum and system can be assumed to be harmonized to a certain extent. Therefore, this paper introduced the manner of parental contributions to schools in Germany, with a focus on public schools in the Land of Baden-Württemberg, and analyzed the underlying laws. In Germany, the content, limits, and modalities of parental contributions to schools are regulated by law in relatively detail. In particular, parental contributions through parental councils is considered widespread, and this is how parents' interests are realized.
