본 연구의 목적은 스포츠에서 ‘스포츠 평등’의 본질적 의미를 탐구하고, 찰스 테일러의 ‘인정의 정치’를 통해 현대 스포츠 사회에서 요구되는 평등의 목적을 제시함으로써 트랜스젠더 선수의 스포츠 참여 정당성을 주장하는 데 있다. 연구는 국·내외 서적과 학술 논문 등의 문헌을 해석하고 비판하는 문헌 연구 방법을 통해 수행되었으며, 공동체주의와 다문화주의 정치 철학을 기반으로 하는 테일러의 ‘인정의 정치’를 이론적 틀로 삼았다. 연구 결과, 트랜스젠더 여성 선수의 스포츠 참여권 문제는 단순히 규범적 공정성의 잣대로 판단할 것이 아니라, 스포츠의 존재 당위성, 스포츠 구성원의 인권, 스포츠 평등 실현의 관점에서 논의되어야 한다. 특히 스포츠 평등은 결과 수용을 위한 도구가 아니라, 스포츠 문화의 다양성과 공동체 유지를 위한 필수 요소로 작동되어야 하며, 트랜스젠더 선수의 스포츠 참여권 허용은 그들의 성적 지향성을 인정하는 것을 넘어 인간으로 기본적인 존엄성의 인정이며, 도덕적 행위의 주체자로서 스포츠를 통해 그들의 정체성이 실현되는 것이다.
Abstract
The purpose of this study is to justify the participation of transgender athletes in sports by exploring the essential meaning of ‘sports equality’ and presenting the objectives of equality required in the modern sports society through Charles Taylor’s ‘Politics of Recognition’. This study employed a literature review method, interpreting and critically analyzing domestic and international books and academic papers. Taylor’s ‘Politics of Recognition’, which is based on the political philosophy of communityism and multiculturalism, was used as a theoretical framework. The findings reveal that the issue of transgender female athletes’ right to participate in sports should not be evaluated solely by the standard of normative fairness. Instead, it should be considered from the perspectives of the justification for the existence of sports, the human rights of sports participants, and the realization of sports equality. In particular, sports equality should not serve merely as a tool for accepting outcomes, but should act as an essential element for diversity in sports culture and maintaining community. Allowing transgender athletes to participate in sports goes beyond recognizing their sexual orientation, enabling the realization of their identity through sports as subjects of moral agency.
