이 연구의 목적은 IOC의 트랜스젠더 선수 포용 정책의 이론적 기저를 이루고 있는 핵심 주장들을 비판적으로 고찰하는 데 있다. 이를 위해 본고는 다음 두 가지 쟁점을 검토하였다. 스포츠라는 행위는 인간의 권리이기에 트랜스여성은 여성 부문에서 경쟁할 마땅한 권리가 있는 것인가? 공정성과 포용성이라는 가치는 조화롭게 균형을 이룰 수 있는 것인가? 본 논문은 다음과 같은 순서로 전개된다. 첫째, 국제스포츠 관리기관인 IOC의 트랜스젠더 선수 관련 규정 변화의 역사를 짚어보았다. 둘째, 트랜스여성 선수의 여성부 참가를 옹호하는 학자들의 주장과 그 이론적 근거를 고찰하였다. 셋째, 트랜스여성 선수의 여성부 참여를 정당화하려는 인권적 접근의 타당성을 비판적으로 분석하였다. 넷째, 스포츠에서 공정성은 합리적인 자격 기준을 통한 건전한 범주화를 이끄는 핵심 규범이며, 포용성은 이 공정성의 가치에 종속되는 것이지, 동등한 지위를 갖는 것이 아님을 논증하였다.
Abstract
The purpose of this study is to critically examine the core claims underlying the theoretical foundation of the International Olympic Committee’s (IOC) policies on the inclusion of transgender athletes. Two key questions are addressed: First, if sport is considered a human right, does a transgender woman possess the rightful claim to compete in the women’s category? Second, can the values of fairness and inclusion be harmoniously balanced in sport? This paper proceeds as follows. First, this study reviews the historical evolution of the IOC’s regulations concerning transgender athletes. Second, it examines the arguments and theoretical justifications advanced by scholars in support of transgender women’s participation in the women’s category. Third, it critically analyzes the validity of a human rights–based approach to legitimizing the inclusion of transgender athletes in women’s events. Finally, this study argues that fairness in sport is the primary normative principle guiding the establishment of reasonable eligibility criteria, while inclusion is subordinate to, rather than equal with, the value of fairness.
