국제사회의 북한인권 개입과 남북한의 대응

이 논문은 국제사회의 북한인권 개입과 관련 남북한의 대응을 살펴보았다. 대체적으로 EU나 UN 인권위원회의 북한인권에의 개입과 개별국가인 미국과 일본의 북한인권법 제정 개입 의도 등은 인권선언에 나타난 인권의 존엄성과 보편성에 기인하는 국제 도덕성을 초월하여 헤게모니적 관점인 국제여론의 압력이나 합리적 선택에 따른 국가이익에 있음을 알 수 있다. 이런 국제추세 속에서 한반도, 특히 북한의 인권문제가 다른 국가나 UN에 의해 좌우되지 않도록 남북한이 북한 인권개선과 통일노력에 주력해야 할 것이다. 이런 문제의식을 바탕으로 국제인권레짐의 실행능력 증진을 위해 다음과 같은 결론을 도출할 수 있다. 첫째, 주변 국가보다 다소 늦었지만, 한국이 북한인권법을 제정하여 북한 인권문제를 주도적으로 해결할 수 있도록 역량을 강화하고 서구 중심의 편향성을 극복해야 할 것이다. 둘째, 그동안 EU나 UN 인권위원회 등이 주도적으로 내세운 대북인권결의안의 장단점을 파악하여 한국이 북한인권결의안의 창구역할을 해내야 할 것이다. 셋째, 한국이 EU나 UN기구, 그리고 미국 및 서구 주요 국가와의 대북인권협의회를 구성하여 주변국들에게 한반도 통일을 한국이 주도하고 있다는 확고한 신념을 보여야 할 것이다. 결국 국제인권레짐의 성공여부는 한반도, 특히 한국이 다른 국가를 설득하여 북한인권문제에 대한 인식의 전환을 도출하는 것이다. 한국이 주변 국가의 북한인권 개입에 적극적으로 대응하고 북한에 선린적으로 다가가 진정한 민족공동체로 우뚝 설 수 있다는 자심감이 무엇보다도 필요한 시기인 것이다.
Abstract
This study looks into response of South and North Korea onto intervention in North Korean human rights by international societies. In general, it is found that the process of intervention in North Korean human rights by EU or UN Human Rights Commissioner and the intention to establish the North Korean Human Rights Acts by individual countries such as USA and Japan lie on international opinion pressure in terms of hegemonic model or national interest according to rational choice model beyond international morality based on human dignity and universality shown in the Declaration of Human Rights. Under such international situation, South and North Korea shall make their best efforts to have improvement of North Korean human rights and reunification in order for the Korean Peninsula, especially issue of North Korean human rights not to be influenced by other countries or a UN agency. On the basis of such critical mind, we can draw following conclusions to improve execution ability of international human rights regime; First, it is necessary for South Korea to establish the North Korean Human Rights Acts, a little late though, and also necessary to overcome Western Europeoriented bias so as to strengthen its competence for taking the initiative in solving the issue of North Korean human rights, Second, it is necessary to grasp merits and demerits of human rights resolution toward North Korea led by EU or UN Human Rights Commissioner and then, our country shall be play a role as a window of such resolution Third, it is necessary for South Korea to organize a North Korean human rights committee in collaboration with EU or UN agency, US and other European main countries in order to tell neighboring countries that South Korea has a definite conviction to lead reunification of the Korean Peninsula. Finally, success of international human rights regime depends on South Korea’s persuasion of other countries to change their understanding about the issue of North Korean human rights. Therefore, it is the right time for us to positively respond to neighboring countries’ intervention in North Korean human rights and to have confidence in standing up as a true ethnic community through an friendly approach to North Korea.
