견제와 균형을 위한 경찰위원회 활성화 방안에 관한 연구

Abstract

The Korean National Police Committee has an inherent characteristic as developed focused on political neutrality and democratic feature of National Police since 1991, birth of the committee. But there has been considerable criticism that the present Korean National Police Commission has been operated far from its fundamental intent, especially to guarantee political neutrality and democracy within the police force. The National Police Commission could achieve its purpose, which the police law follows, only when the commission exercises it’s right to oversee the police agency as an independent organization. First, the Commission ought to perform its functions which are to assure safe society and human rights of the people through watching and checking rather than consulting. Second, it is necessary to convert the commission into a permanent organization not current non-permanent institution. Third, even though the function and authority of the commission is upgraded, if the post-control system does not work properly on the deliberated and decided by the commission, it wouldn’t guarantee the effectiveness of deliberation of the commission. Lastly, the members of the commission shall consist of at least 9 to 12 including 3 standing members and be placed under the Prime Minister, not under the Ministry of the Interior and Safety.
