경찰위원회는 경찰의 정치적 중립성을 보장하고 경찰권 행사에 대한 외부적 통제를 목적으로 설치되었다. 그러나 경찰위원회는 행정안전부에 설치되어 있고, 자체 사무국없이 그 운영을 경찰청에서 하도록 하고 있어 행정위원회가 아니라 자문위원회로서의 역할에 머물러 있다. 또한 경찰위원회의 결정에 불복할 수 있는 수단을 정부에게 부여함으로써 경찰에 대한 통제를 효과적으로 수행할 수 없다는 비판을 받고 있다. 본 논문은 경찰의 지위와 역할강화에 대응하는 실질적인 통제기구로서 경찰위원회의 위상 정립 방안을 제시함에 있다. 이를 위해서 본 논문은 소망성과 실현가능성을 평가하는 기준으로 하여 현 경찰위원회를 분석함으로써 처음부터 경찰위원회가 직접적으로 경찰행정사무에 대하여 견제하고 감독권을 행사하기란 법률적으로 불가능하다는 점을 밝혀내었다. 본 논문은 이를 바탕으로 경찰에 대한 실질적인 통제기구로서의 경찰위원회의 위상과 역할을 정립하는 방안을 아래와 같이 제시하였다. 첫째, 경찰위원회는 경찰기관을 감독하는 기관으로 승격시켜서 경찰정책에 대한 최종결정권을 행사하여야 한다. 둘째, 경찰 구성원의 부정부패를 예방하기 위해 감찰기능을 행사하여야 한다. 셋째, 경찰을 대상으로 하는 민원 및 불만을 해결하는 기능을 수행하여야 한다. 이러한 경찰위원회의 역할이 효과적으로 실현되기 위해서는 우선적으로 경찰위원회의 독립적인 지위가 보장되어야 한다.
Abstract
The National Police Commission was established with the aim of assuring the political neutrality of the police and externally controlling police activities. However, the NPC is set up in the Ministry of the Interior and Safety, and its operation is carried out by the police agency without its own organization. It is also criticized for not being able to effectively control the police by giving the government(the Ministry of the Interior and Safety) the means to disagree with the police commission's decision. This paper suggests the establishment of the NPC as a practical control commission to cope with the strengthening of police status and role. For this purpose, this paper analyzed the current NPC as a criterion for evaluating Desirablity and Feasibility and revealed that it is legally impossible for the NPC to directly control police activities and to exercise supervision rights. In this paper, we propose suggestions to establish the status and role of the NPC as a practical control commission for police based on the following. First, the NPC should be raised to the public administrative commission to supervise the police agency and exercise the final decision on police policy. Second, the NPC should have the function to inspect the police officers to prevent corruption. Third, the NPC should perform the function of resolving complaints of civilians. In order for the role of the NPC to be effective, its independent positioning should be secured first.
