한국의 경찰위원회제도 현황분석과 개선방안

경찰위원회는 경찰의 인사 및 업무발전 등에 관한 사항을 심의‧의결하는 기능을 가진 합의제 형태로 정치적 중립성과 민주성을 확보하여 효율적인 경찰기관을 관리하기 위한 기관으로 1991년에 설립되었다. 이러한 경찰위원회는 설립 당시의 경찰이념인 정치적 중립성, 민주성, 효율성 등을 제대로 수행하지 못하여 형식적인 경찰행정관리기관으로 존재한다는 지적을 받아왔다. 따라서 이 연구에서는 경찰위원회의 현황 분석을 중심으로 그에 따른 개선방안을 제시하고자 하였다. 첫째, 정치적 중립성의 확보를 위하여 위원선임의 방법을 개선해야 한다. 현재 안전행정부장관의 추천권을 위원 7인에 대하여 행정부 2인, 입법부 2인, 사법부 2인, 경찰청장 1인이 추천권을 행사하여 국회의 동의를 거쳐 대통령이 임명하도록 하여야 하며 광범위하게 인정되는 안전행정부장관의 재의요구권을 엄격하게 규정하여 재의요구권에 대한 재량권 남용을 방지하여 정치적 중립성을 확보하여야 한다. 둘째, 민주성을 확보해야 한다. 민주성을 확보하기 위하여 위원의 선정에 있어서 각 분야의 대표성을 반영하기 위하여 특정 분야의 수를 제한하고 다양한 시민들이 참여할 수 있는 방안으로 개선해야 한다. 셋째, 효율성을 개선해야 한다. 정기회의를 최소 월 2회 정도로, 경찰청 내의 사무국을 경찰청으로부터 독립하고 전문위원을 확보하여 실질적인 심의·의결이 될 수 있도록 개선해야 하며, 전문성확보를 통한 효율성 향상을 위하여 위원 자격을 현재의 소극적인 방안에서 적극적인 방안으로 개선하여 위원 및 위원장의 자격요건으로 전문성을 강화하여 경찰에 대한 전문적인 지식과 경력을 겸비한 전문가를 선임하도록 해야 한다.
Abstract
The police committee in Korea was established in 1991, as a form of a panel of judges with the functions of discussing and deciding things about personnel affairs and service development of the police, for the purpose of attaining political neutrality and democracy to efficiently manage the police organizations. As the establishing ideas of this committee such as political neutrality, democracy, and efficiency and so on have not been taken care of, it has been merely a formal administrative organization of the police. Therefore, this study aimed to provide measures to improve this organization focusing on the current status analysis of this committee. First, in order to obtain political neutrality, ways to select a committee member should be improved. Currently, the ministry of public administration and security recommends seven members; these members should be recommended by different organizations: two members by administration, two by legislation, two by judicature, and one by the chief of National Police Agency, and which should be appointed by the president of Korea with the consent of National Assembly. By strictly restricting the ministry of public administration and security's reconsideration request that is being widely accepted, its abuse will be prohibited, and the political neutrality would be attained. Second, democracy needs to be obtained. To attain democracy in the process of selecting the committee members, the number of members in a particular area should be limited and a variety of citizens should participate in the selection, for the purpose of reflecting representation of each area. Third, efficiency needs to be improved. Regular meetings should be held, at least about two times a month, so that executive offices within the National Police Agency could be separated. And expert advisory members need to be obtained to make this organization's consideration/judgement more realistic. Finally, to select the experts who have both professional knowledge and experience about the police, the members qualification measure, which is now passive, should be improved to be more active, so that expertise should be supplemented as the qualification of the committee members and the chairman.
