상담자의 윤리적 판단 모형 - 철학적 논의와 사례 적용 -

본 연구의 목적은 윤리적 의사결정이 요구되는 상황에서 상담자가 자신의 판단과정을 대비하여 검토해 볼 수 있는 윤리적 판단 모형을 구상하여 제시하는 것이다. 이를 위해 기존의 상담자 윤리, 윤리적 의사결정 모형의 내용과 한계를 살펴보았다. 그리고 의사결정 과정을 보완 할 수 있는 윤리적 판단의 도출과정에 대한 모형을 철학적 논의에 기초해 탐색적으로 제시하였다. 윤리적 판단 모형은 윤리규정이 마련되지 못한 상황, 윤리규정을 명확하게 적용하기 어려운 상황, 특히 윤리적 가치가 충돌하여 딜레마가 발생하는 상황에 초점을 두었다. 모형 도출은 개인적 가치와 사회적 가치가 상충하는 상황에 대한 전통적인 윤리적 접근방법 즉 의무론과 결과론적 접근에 기초하였으며 이를 통해 3단계 모형을 제시하였다. 윤리적 판단을 위한 3단계 모형은 공리적 관점의 대안모색, 해당 대안의 의무론적 관점에서의 정당성, 그리고 가치 충돌 상황에서 의무론적 대안 선택 단계를 포함하였다. 이어서 제안된 모형에 대한 상담자 교육과 실제에서 지닐 수 있는 적용 가능성과 한계에 대해 논의하였다.
Abstract
The purpose of this study is to present theoretical underpinnings of ethical decision-making process in counseling and to suggest the complementary decision-making model based on ethics and philosophy. Existing ethical decision-making process is mainly depending on ethical codes or standards given by a few associations and decision-making models. Nowadays researchers and practitioners has generated common reaction especially in that ethics are complex and have far-reaching implications for the practice of counselling and ethical decision-making could always be influenced by values and moral position. However few studies have been reported as to what alternative approaches viewed in ethics and moral theories could be taken. It is our view that various issues raised in the field regarding ethical decision-making process and alternative strategies for facilitating fit between existing ethical decision-making process and real situation in practice might be resolved through philosophical and ethical agendas. We examined several decision-making models in the field of counseling and social welfare and suggested the ethical decision-making model based on utilitarianism and deontological moral theory. We think the model suggested in this study would be complementary cooperation of existing ethical decision-making process in counseling.
