Abstract

The rapid advancement of science and technology has brought significant benefits to society, but it has also generated new forms of risk, particularly in relation to individual rights and freedoms. Modern technologies such as artificial intelligence are developing at an unprecedented pace, accompanied by increased complexity and opacity. Traditional command-and-control regulatory models, once sufficient to manage risks arising from scientific innovation, are now inadequate in addressing the uncertainties associated with contemporary technological developments. This article examines theoretical approaches to risk regulation within the German science and technology law framework, with a focus on recent regulatory trends concerning artificial intelligence and data technologies. It argues that while scientific risks are inherently uncertain, the state is nonetheless obligated to regulate them based on its duty to protect fundamental legal interests. At the same time, regulation must be carefully designed to avoid stifling future research and innovation. In response to these challenges, co-regulatory models involving both public and private actors have become increasingly prominent, offering greater flexibility and expertise in adapting to technological change. Furthermore, regulatory intensity should vary according to the level of risk, and although risk assessments are grounded in the latest scientific knowledge, they inevitably include normative value judgments and balancing considerations. Ultimately, this article highlights the need for a dynamic and differentiated regulatory approach—one that seeks to minimize risks while simultaneously fostering the sustainable development of science and technology.
