한･인도 CEPA의 품목별 원산지규정 특징과 활용률 분석

본 연구는 한･인도 CEPA의 저조한 활용률의 주요 요인으로 지적되고 있는 원산지규정에 대한 실증분석 결과를 제시하고 있다. 우리나라가 체결한 여러 FTA 가운데 한･ASEAN FTA와 한･인도 CEPA에서만 품목별 원산지결정기준에 명시되지 않는 품목에 일반기준을 적용하는 방식을 채택했으며, 특히 한･인도 CEPA에서는 일반기준으로 6단위 세번변경기준(CTSH)과 부가가치기준(RVC35%)을 동시에 충족시켜야하는 결합기준이 적용된 것이 특징이다. 한･인도 CEPA의 품목별 원산지결정기준의 가장 큰 취약점이 이 일반기준이 적용되는 품목이 많다는 점이며, 실증분석 결과를 통해서도 한･인도 CEPA에 따른 수입거래 규모와 특혜수준은 FTA 활용률에 긍정적인 영향을 미치는 반면 원산지규정의 복잡성 혹은 엄격성은 예상한 바와 같이 부정적인 영향을 미치는 것으로 파악되었다. 본 연구에서 살펴본 바와 같이 우리나라의 대인도 수입은 분석기간 동안 감소하고 있지만, 한･인도 CEPA에 따른 특혜관세 혜택을 받을 수 있는 품목의 수입규모는 증가하고 있으며 활용률도 지속적으로 개선되는 추세이다. 그럼에도 불구하고 본 연구를 통해 원산지규정의 복잡성이 한･인도 CEPA의 경제적 효과에 미치는 부정적인 영향력이 확인된 만큼 이에 대한 효율적인 대책 마련이 필요해 보이며, 특히 현재 진행 중인 한･인도 CEPA 개선협상에서 원산지결정기준에 대한 개선 관련 실질적인 성과가 나올 수 있도록 집중적인 노력이 필요해 보인다.
Abstract
In this paper, we examine the product-specific rules of origin and the utilization rates of Korea-India Comprehensive Economic Partnership Agreement (CEPA) that came into effect on 1st January 2010. Using Korea trade data that spans from 2012 to 2016, we empirically study the determinants of the utilization rates of Korea-India CEPA. We find that both the import value and preference margin is positively associated with utilization rates while the restrictiveness of the rules of origin is negatively associated. Because the general rule of the origin determination under the Korea-India CEPA is 35% of Regional Value Content (RVC) and Change in Tariff Sub-Head (CTSH), such combination of different methods of determining origin could be more restrictive than satisfying a single rule. Thus, we also empirically examine whether this combined rule such as CTSH+RVC(35%) hampers the use of FTA compared to other simple rules. Although we find some evidence that rules used in combination could be more restrictive than single rules, the results are not robust. As the empirical results do point out that restrictive rules of origin negatively affects FTA utilization rates, we conclude that it is necessary for both Korea and India to make an effort on reducing the restrictiveness of the rules of origin through their ongoing CEPA talks for upgrading trade pact.
